Формування економічних механізмів функціонування ринку землі в Україні

Abstract

UA : Кваліфікаційна робота :88 с.,4 таб., 3 рис.,40 джерел. Об’єктом дослідження є ринок землі, механізми формування економічних механізмів функціонування ринку землі. Предметом дослідження є обіг земельних ділянок ,тобто перехід права власності від одного власника до іншого на підставі цивільно-правових угод, рішення суду тощо. Метою дипломної роботи є розкриття питання формування , використання механізмів регулювання ринку землі в Україні. Для досягнення поставленої мети в роботі були поставлені і вирішені наступні питання : -визначити інфраструктуру ринку землі та її характеристику; -проаналізувати законодавчо-нормативне забезпечення регулювання ринку землі; -дослідити механізми продажу та перереєстрацію земельних ділянок або прав на них ,в тому числі на підставі цивільно -правових договорів, а також на конкурентних засадах; -розкрити організаційно-правові та економічні засади регулювання ринку землі; -проаналізувати правове регулювання ринку землі. Методи дослідження .У процесі дослідження було використано загальнонаукові та спеціально-юридичні методи наукового пізнання. Застосування діалектичного методу дозволило дослідити торговельно-господарські відносини, що виникають в процесі перерозподілу земель та прав на них між суб’єктами ринку землі на основі конкурентного попиту та пропозиції . Дослідження змісту нормативно-правових актів ,що регулюють ринкові відносини в Україні здійснювалося за допомогою формально-логічного методу. Використано метод при дослідженні ринку землі та аналіз диспозицій окремих статей Земельного кодексу. Інформаційною базою дослідження послужили законодавчі та нормативно-правові акти України ,електронні інформаційні ресурси, офіційні матеріали Головного управління Держгеокадастра , Державного агентства земельних ресурсів України, довідково -нормативні матеріали та наукові дослідження та література за темою дослідження.

The object of research is the land market, the mechanisms of formation of the economic mechanisms of the functioning of the land market. The subject of the study is the transfer of land plots, that is, the transfer of ownership from one owner to another on the basis of civil law agreements, court decisions, etc. The aim of the thesis is to reveal the issue of formation and use of land market regulation mechanisms in Ukraine. In order to achieve the set goal, the following questions were raised and resolved in the work: - determine the infrastructure of the land market and its characteristics; - to analyze legislative and regulatory support for the regulation of the land market; - study the mechanisms of sale and re-registration of land plots or rights to them, including on the basis of civil-law contracts, as well as on a competitive basis; - reveal the organizational, legal and economic principles of land market regulation; - to analyze the legal regulation of the land market. Research methods. In the research process, general scientific and special legal methods of scientific knowledge were used. The application of the dialectical method made it possible to investigate trade and economic relations arising in the process of redistribution of land and rights to it between subjects of the land market on the basis of competitive supply and demand. The study of the content of legal acts regulating market relations in Ukraine was carried out using the formal-logical method. The method was used in the study of the land market and the analysis of the dispositions of individual articles of the Land Code. Legislative and regulatory acts of Ukraine, electronic information resources, official materials of the Main Directorate of the State Geocadastre, the State Agency of Land Resources of Ukraine, reference and regulatory materials and scientific research and literature on the topic of the study served as the information base of the research.
