Юридична природа нормативно-правових актів Кабінету Міністрів України

Abstract

UA : Робота викладена 108 сторінках друкованого тексту. Перелік посилань включає 82 джерела. Об’єктом кваліфікаційної роботи є суспільні відносини у сфері нормотворчої діяльності Кабінету Міністрів України. Предметом дослідження є юридична природа нормативно-правових актів Кабінету Міністрів України. Формування сучасного розуміння актів уряду, притаманних їм ознак, а також їх місця в системі нормативно-правових актів держави було тривалим процесом, протягом якого одні характеристики втрачали актуальність, а інші підтверджували своє значення. Тривалим та нелінійним був також процес розвитку правотворчої техніки та технології створення урядових актів. Беручи свої основи у роботах давньогрецьких мислителів, спираючись на доробок філософів Нового часу, знання у цих галузях істотно модифікувалися та набули нових масштабів. На сьогоднішній день накопичено значний обсяг наукового матеріалу, який потребує опрацювання та систематизації з врахування сучасних тенденцій розвитку правової науки. Метою кваліфікаційної роботи є з’ясування правової природи НПА КМУ, формулювання основних вимог правотворчої техніки і правил правотворчої технології, що забезпечують їхню якість.

The object of qualification work is public relations in the sphere of rulemaking activity of the Cabinet of Ministers of Ukraine. The subject of the study is the legal nature of the regulations of the Cabinet of Ministers of Ukraine. Forming a modern understanding of governmental acts, their inherent features, and their place in the system of legal acts of the state was a long process, during which some characteristics lost relevance and others confirmed their importance. The process of developing law-making and government-creating technology has also been a long and non-linear one. Taking their foundations in the works of ancient Greek thinkers, relying on the achievements of modern-day philosophers, knowledge in these fields has been significantly modified and acquired new scales. To date, a considerable amount of scientific material has been accumulated, which needs to be elaborated and systematized to take into account current trends in the development of legal science. The purpose of the qualification work is to find out the legal nature of the CMU acts, to formulate the basic requirements of law-making technique and rules of law-making technology that ensure their quality.
