Правовий захист ВІЛ-інфікованих людей в Україні

Abstract

UA : Робота викладена 95 сторінках друкованого тексту. Перелік посилань включає 72 джерела. Об’єктом дослідження даної кваліфікаційної роботи суспільні відносини, що виникають у зв'язку з захистом прав ВІЛ-інфікованих осіб в Україні. Предметом дослідження є захист прав і свобод ВІЛ-інфікованих осіб в Україні. Демократичний розвиток держави передбачає вдосконалення форм та методів співпраці органів державної влади з громадськістю, використання нових, сучасних її інструментів. Саме тому, Уряд України визнає важливість контролю і відстеження перебігу епідемії ВІЛ-інфекції. Крім того, Стратегія реформи охорони здоров’я України містить зобов‘язання щодо поліпшення здоров’я всіх громадян за допомогою комплексних послуг з профілактики та лікування ВІЛ. Це передбачає виконання кількох останніх законів, політик і нормативних актів, спрямованих на зміцнення правового середовища країни у сфері ВІЛ. Проте існують і недоліки. Захист прав ВІЛ є одним з пріоритетів державної політики, вона законодавчо закріплена цілою низкою державних гарантій. Основні проблеми в досягненні цілей цієї політики тісно пов’язані з відсутністю міжвідомчої координації та відчутним недофінансуванням заходів з право просвітницької роботи щодо забезпечення прав ВІЛ-інфікованих з державного та місцевих бюджетів. Незважаючи на це, на національному рівні більшу увагу варто звернути на проведення інформаційних заходів щодо проблем ВІЛ-інфекції серед основних груп населення, а також на підвищення рівня поінформованості громадськості. Ці зусилля сприятимуть зменшенню числа нових випадків інфікування на національному рівні та зниженню соціальної стигми, спрямованої проти цих груп. Метою кваліфікаційної роботи є концептуальний аналіз нормативно-правової бази інших країн та законодавства Україні в сучасних умовах, розробка рекомендацій та пропозицій до чинного законодавства з питань захисту прав ВІЛ-інфікованих в Україні.

The object of the study of this qualification is the public relations that arise in connection with the protection of the rights of HIV-positive persons in Ukraine. The subject of the study is the protection of the rights and freedoms of HIV-positive persons in Ukraine. The democratic development of the state implies the improvement of forms and methods of cooperation of public authorities with the public, the use of new, modern instruments. That is why the Government of Ukraine recognizes the importance of controlling and monitoring the progress of the HIV epidemic. In addition, the Healthcare Reform Strategy of Ukraine contains commitments to improve the health of all citizens through comprehensive HIV prevention and treatment services. This involves implementing several recent laws, policies and regulations aimed at strengthening the country's legal environment in the field of HIV. However, there are drawbacks. The protection of HIV rights is one of the priorities of the state policy, it is enshrined in legislation by a number of state guarantees. The main problems in achieving this policy are closely linked to the lack of interagency coordination and a significant underfunding of awareness-raising measures to ensure the rights of HIV-positive people from the state and local budgets. Nevertheless, greater attention should be paid at national level to awareness-raising activities on HIV among the main population, as well as to raising public awareness. These efforts will help reduce the number of new infections at national level and reduce the social stigma against these groups. The purpose of the qualification work is a conceptual analysis of the legal framework of other countries and legislation of Ukraine in the current conditions, development of recommendations and proposals to the current legislation on protection of the rights of HIV-infected people in Ukraine.
