Abstract

Конституція України - Основний Закон нашої держави, не тільки законодавчо закріплює права і свободи людини і громадянина, а й визначає, що їх захист є обов'язком держави. Це загальне правило зобов'язує державу різними правовими засобами забезпечувати захист конституційних прав і свобод, здійснювати їх регулювання. Проведення цієї багатоаспектної діяльності вимагає наявності у держави певних структур, органів, які здійснювали б постійний контроль і нагляд за виконанням законів, інших нормативних актів, а також дотриманням Конституції України. Одним з таких правозахисних для української правової системи механізмів (органів) була і залишається прокуратура, яка здійснює нагляд за дотриманням Конституції України і виконанням законів, що діють на її території. Здійснюючи правозахисну діяльність, прокурор розглядає і перевіряє заяви, скарги та інші повідомлення про порушення прав і свобод людини і громадянина; роз'яснює постраждалим порядок захисту їх прав і свобод; вживає заходів щодо попередження та припинення порушень прав і свобод людини і громадянина, притягнення до відповідальності осіб, які порушили закон, та відшкодування заподіяної шкоди. Таким чином, прокуратура наділена необхідними повноваженнями, що дозволяють їй надійно відстоювати права і свободи людини і громадянина. Ці повноваження розраховані на активне їх застосування прокурорами. Метою кваліфікаційної роботи є дослідження проблем захисту прав і свобод людини і громадянина прокуратурою України. Об’єктом кваліфікаційної роботи є суспільні відносини в сфері захисту прав і свобод людини органами прокуратури. Предметом дослідження є правове регулювання захисту прокуратурою України прав і свобод людини і громадянина.

The Constitution of Ukraine - The Basic Law of our state, not only legislates for the rights and freedoms of man and citizen, but also determines that their protection is the duty of the state. This general rule obliges the state by various legal means to ensure the protection of constitutional rights and freedoms, to exercise their regulation. Conducting this multidimensional activity requires the presence in the state of certain structures, bodies, which would exercise constant control and supervision over the implementation of laws, other normative acts, as well as compliance with the Constitution of Ukraine. One of such human rights mechanisms (organs) for the Ukrainian legal system was and remains the prosecutor's office, which oversees the observance of the Constitution of Ukraine and the implementation of laws in its territory. In carrying out human rights activities, the prosecutor examines and checks allegations, complaints and other reports of violations of human and citizen's rights and freedoms; explains to the victims the procedure for the protection of their rights and freedoms; takes measures to prevent and stop violations of human and citizen's rights and freedoms, to prosecute persons who violate the law, and to compensate for the harm caused. Thus, the prosecutor's office is endowed with the necessary powers to enable it to defend the rights and freedoms of the individual and the citizen. These powers are designed to be actively used by prosecutors. The purpose of the qualification work is to investigate the problems of protection of human and citizen's rights and freedoms by the Prosecutor's Office of Ukraine. The object of qualification work is public relations in the field of protection of human rights and freedoms by the prosecuting authorities. The subject of the study is the legal regulation of the protection of human and civil rights and freedoms by the Prosecutor's Office of Ukraine.
