Проблеми правового захисту дітей за законодавством України

Abstract

У зв’язку з особливостями економічного і соціального розвитку країн, все більшого поширення набуває таке явище, як проблема захисту прав дітей. Повний і всебічний розвиток особистості дитини, створення необхідних умов для реалізації і захисту її прав і свобод є головним пріоритетом будь-якої сучасної держави. За законодавством України захищеність прав неповнолітніх, їх благополуччя є головним національним стратегічним пріоритетом, що пояснюється роллю молодого покоління в забезпеченні життєздатності суспільства та прогнозуванні його розвитку. Законодавство, особливо в таких стратегічних галузях, як захист дитинства, має важливе значення, особливо на сучасному етапі. В Україні сформована нормативно-правова база для реалізації заходів щодо захисту молодого покоління. Проте, не зважаючи на досить широку нормативно-правову базу, захист прав неповнолітніх Україні ще не досяг необхідного рівня, про що свідчать численні порушення прав дитини в різних сферах: щодо дотримання та забезпечення здійснення особистих немайнових прав дітей, в сфері праці та навчання, медичної допомоги, майнових прав дітей, сімейних прав та ін. Метою кваліфікаційної роботи є визначення на основі аналізу чинного законодавства та практики його застосування, основних проблем правового регулювання відносин за участю дітей, правового забезпечення прав дітей та гарантії їх забезпечення, охорони та захисту їх прав, проблеми забезпечення та захисту прав дітей та пропозиції щодо їх вирішення. Об’єктом дослідження даної кваліфікаційної роботи є суспільні відносини, які виникають у сфері забезпечення прав і свобод дитини, створенням умов для всебічного розвитку дитини, охорони, реалізації та захисту її прав та свобод. Предметом дослідження є проблеми правового захисту дітей за законодавством України.

According to the legislation of Ukraine, the protection of the rights of minors, their well-being is a major national strategic priority, which is explained by the role of the young generation in ensuring the viability of society and predicting its development. Legislation, especially in strategic areas such as childhood protection, is essential, especially at the current stage. In Ukraine, a legal framework has been formed to implement measures to protect the younger generation. However, despite the relatively broad legal framework, the protection of minors' rights in Ukraine has not yet reached the required level, as evidenced by numerous violations of the rights of the child in various spheres: the observance and enforcement of the personal non-property rights of children, in the sphere of work and education, medical assistance, property rights of children, family rights, etc. The purpose of the qualification work is to determine, on the basis of an analysis of the current legislation and practice of its application, the main problems of legal regulation of relations with the participation of children, legal protection of the rights of children and the guarantee of their protection, protection and protection of their rights, problems of ensuring and protection of children's rights and proposals for their solution. . The object of study of this qualification work is the social relations that arise in the sphere of protection of the rights and freedoms of the child, creation of conditions for the full development of the child, protection, realization and protection of his rights and freedoms. The subject of the study is the problems of legal protection of children under the legislation of Ukraine.
