Правове регулювання діяльності політичних партій у виборчому процесі

Abstract

UA : Актуальність теми зумовлена розвитком України як демократичної держави, в якому значну роль відіграють виборчий процес та політичні партії адже розвиток політичної системи сприяє розвитку плюралізму поглядів на правління державою, що є невід’ємною частиною демократичної держави . Розвиток української державності не може відбуватись без вдосконалення, та розвитку законодавства, що забезпечує демократизм державного ладу. Правове регулювання виборчого процесу є важливою складовою загального конституційного розвитку України. Мета дослідження – аналіз чинного стану правового регулювання відносин у сфері виборчого, правового регулювання діяльності політичних партій у виборчому процесі. Визначена мета зумовила постановку і вирішення наступних завдань:  проаналізувати стан правового регулювання правовідносин у сфері виборчого процесу;  встановити існуючі міжнародні нормативно-правові акти, що регулюють виборчий процес та діяльність політичних партій в виборчому процесі в країнах Європейського Союзу;  проаналізувати прояв міжнародних виборчих стандартів в законодавстві України;  проаналізувати законодавство України що регулює виборчий процес;  проаналізувати законодавство України, що регулює діяльність політичних партій у виборчому процесі;  виявити вади та недоліки законодавства у сфері виборчого процесу та діяльності політичних партій у виборчому процесі.  надати пропозиції щодо реформування законодавства, яке забезпечує правове регулювання діяльності політичних партій у виборчому процесі Об’єктом дослідження є суспільні відносини в сфері виборчого процесу, особливості їх нормативно-правового забезпечення та регулювання. Предметом дослідження є правові засади регулювання участі політичних партій у виборчому процесі України в контексті європейських стандартів Методологічна основа дослідження зумовлена метою та завданнями кваліфікаційної роботи та відповідає цілісному підходу до вирішення сформульованої проблеми. Дослідження базується на принципі використання системності та комплексності, поєднанні різних наукових методів і підходів пізнання явищ правової дійсності. Методологічною основою дослідження теоретичних аспектів організації та функціонування інституційних механізмів, спрямованих на правове регулювання діяльності політичних партій у виборчому процесі, є наукові методи пізнання: діалектики, порівняльно-правовий, історично-правовий, аналізу, прогностичний. В комплексі вони дозволяють в повній мірі проаналізувати правове регулювання діяльності політичних партій у виборчому процесі, виявити недоліки та проблеми такого регулювання, та розробити пропозиції що до вдосконалення правового регулювання діяльності політичних партій у виборчому процесі виборчий процес, політичні партії, правове регулювання вибориб, політика, депутати, участь у виборах, виборче право.

EN : The urgency of the topic is conditioned by the development of Ukraine as a democratic state, in which the electoral process and political parties play a significant role, since the development of the political system contributes to the development of pluralism of views on the rule of the state, which is an integral part of a democratic state. The development of Ukrainian statehood cannot take place without improvement, and the development of legislation that ensures the democracy of the state system. Legal regulation of the electoral process is an important component of Ukraine's overall constitutional development. The purpose of the study is to analyze the current state of the legal regulation of relations in the electoral sphere, the legal regulation of the activities of political parties in the electoral process. The determined goal led to the formulation and solution of the following tasks: − to analyze the state of legal regulation of legal relations in the sphere of electoral process; − to establish the existing international normative legal acts regulating the electoral process and the activities of political parties in the electoral process in the countries of the European Union; − to analyze the manifestation of international electoral standards in the legislation of Ukraine; − analyze the legislation of Ukraine governing the electoral process; − analyze the legislation of Ukraine governing the activities of political parties in the electoral process; − identify the shortcomings and shortcomings of the legislation in the electoral process and the activities of political parties in the electoral process. − submit proposals for reforming legislation that provides for legal regulation of political parties' activities in the electoral process The object of the study is the public relations in the electoral process, the peculiarities of their legal support and regulation. The subject of the study is the legal basis for regulating the participation of political parties in the electoral process of Ukraine in the context of European standards The methodological basis of the research is determined by the purpose and tasks of the qualification work and corresponds to a holistic approach to solving the formulated problem. The research is based on the principle of using systematic and comprehensive, the combination of different scientific methods and approaches to the knowledge of the phenomena of legal reality. The methodological basis for the study of theoretical aspects of the organization and functioning of institutional mechanisms aimed at the legal regulation of political parties in the electoral process are scientific methods of cognition: dialectics, comparative law, historical law, analysis, prognostic. In the complex, they allow to fully analyze the legal regulation of the activities of political parties in the electoral process, to identify the shortcomings and problems of such regulation, and to develop proposals to improve the legal regulation of the activities of political parties in the electoral process. electoral process, political parties, legal regulation of elections, politics, members, election, election law.
