Конституційно-правові засади організації місцевого самоврядування в умовах децентралізації: досвід країн Європи

Abstract

UA : Кваліфікаційна робота складається зі 124 сторінок, містить 77 джерел використаної інформації. Пріоритетними напрямками серед національних реформ є подальша демократизація суспільства, децентралізація владних повноважень на засадах субсидіарності. Слід зазначити, що нові тенденції у публічному будівництві нашої країни, становлення інститутів громадянського суспільства, оптимізація системи публічного управління обумовлюють нові умови реалізації децентралізації за умови збереження ідей правової держави. Модернізація публічної влади повинна відбуватися у напрямі створення людиноцентристської системи публічного управління, яка буде невід’ємним елементом механізму соціально-політичного захисту населення. У цих умовах, депутати місцевих рад, депутати об’єднаних громад, посадові особи органів місцевого самоврядування, державні службовці мають бути досить обізнаними не тільки конкретних нормах окремих законів, що регулюють діяльність власне місцевих рад та їх депутатів, а розуміти всю суть змін системи місцевого самоврядування в Україні, роль різних владних інституцій у цьому процесі. Децентралізація передбачає створення нової моделі територіальної організації влади, розподіл завдань, повноважень та відповідальності; розвиток системи місцевого самоврядування і формування спроможних територіальних громад, удосконалення державної регіональної політики тощо. Водночас успішне здійснення реформ децентралізації тісно пов’язане з формуванням нової генерації місцевих політиків та службовців органів місцевого самоврядування, які будуть діяти в принципово нових умовах та які потребують нових знань, умінь і навичок. Це викликано, зміною статусу територіальних громад та тих перспективних завдань, що постають перед місцевою владою. Об’єктом кваліфікаційної роботи виступають суспільні відносини в сфері конституційно-правової організації місцевого самоврядування в умовах децентралізації. Предметом дослідження є інститут місцевого самоврядування в умовах реформи децентралізації та досвід країн Європи у впровадженні цього процесу у публічне життя.

Priority directions among national reforms are further democratization of society, decentralization of power on the basis of subsidiarity. It should be noted that new trends in the public construction of our country, the formation of civil society institutions, optimization of the public administration system determine the new conditions for decentralization, while maintaining the ideas of the rule of law. Modernization of public power should take place in the direction of creating a human-centered system of public administration, which will be an integral part of the mechanism of socio-political protection of the population. In these circumstances, deputies of local councils, deputies of united communities, officials of local governments, civil servants must be sufficiently aware not only of the specific rules of individual laws governing the activities of local councils and their deputies, but to understand the essence of changes in the local system. self-government in Ukraine, the role of various government institutions in this process. Decentralization involves the creation of a new model of territorial organization of power, the distribution of tasks, powers and responsibilities; development of the system of local self-government and formation of capable territorial communities, improvement of the state regional policy, etc. At the same time, the successful implementation of decentralization reforms is closely linked to the formation of a new generation of local politicians and local government officials who will operate in a fundamentally new environment and who need new knowledge, skills and abilities. This is due to the change in the status of territorial communities and the promising challenges facing local authorities. The object of qualification work is public relations in the field of constitutional and legal organization of local self-government in the conditions of decentralization. The subject of the study is the institution of local self-government in the context of decentralization reform and the experience of European countries in implementing this process in public life.
