Правовий захист журналістів в Україні в умовах війни

Abstract

UA : Тема магістерської роботи: Правовий захист журналістів в Україні в умовах війни. Обсяг основного тексту: 83 сторінки. Кількість використаних джерел: 99. Мета дослідження – здійснення комплексного аналізу трансформації правового статусу журналіста в умовах правового режиму воєнного стану, виявлення ефективності національних і міжнародних механізмів гарантування безпеки медіапрацівників та розробка пропозицій щодо їхнього вдосконалення. Мета роботи передбачає виконання таких завдань: 1) розкрити теоретико-правові підходи до визначення статусу журналіста та «медіа-учасника» в умовах збройного конфлікту; 2) проаналізувати відповідність національного законодавства міжнародним нормативним стандартам захисту журналістів та інших медіапрацівників в умовах війни; 3) дослідити типологію та динаміку суспільно небезпечних посягань проти журналістів та законного порядку здійснення журналістської діяльності до та після 24 лютого 2022 року; 4) оцінити реальний стан досудового розслідування кримінальних правопорушень у зв’язку зі здійсненням журналістської діяльності методом порівняльного статистичного аналізу; 5) провести опитування представників медіаспільноти щодо дієвості заходів безпеки та інших гарантій правового статусу журналістів в умовах повномасштабної російсько-української війни. Об’єктом дослідження є професійна діяльність журналістів як об’єктів правового захисту та медіаправового регулювання в умовах повномасштабного вторгнення. Предмет дослідження – механізми адміністративно-правового, кримінального й соціального захисту журналістів, а також практика їхньої реалізації в умовах бойових дій в Україні та оцінка їх ефективності медіаспільнотою. Отримані результати: здійснено моніторинг ефективності розслідування кримінальних правопорушень проти журналістів. Досліджено вплив системи військового зонування та акредитації на роботу медіа, виявлено правові колізії між Законом «Про медіа» та підзаконними актами щодо соціальних виплат постраждалим під час виконання професійних обов’язків у зоні бойових дій журналістам. Визначені основні загрози для «нових медіа-акторів» (фіксерів, блогерів) та обґрунтовано необхідність впровадження статусу «військового кореспондента» за міжнародним зразком. Проаналізовано ставлення медіаспільноти до засобів захисту, що підтвердило неефективність формальних посвідчень без реального фізичного захисту та страхування.

EN : The Master’s paper is dedicated to the analysis of such a topical problem as Legal Protection of Journalists in Ukraine During Wartime. Volume of main text: 83 pages. Number of sources used: 99. The object of the research is the professional activity of journalists as objects of legal protection and media legal regulation under the conditions of the full-scale invasion. The subject of the research is the mechanisms of administrative-legal, criminal, and social protection of journalists, as well as the practice of their implementation in combat conditions in Ukraine and the assessment of their effectiveness by the media community. The main aim of the research consists in conducting a comprehensive analysis of the transformation of the legal status of a journalist under the legal regime of martial law, identifying the effectiveness of national and international mechanisms for guaranteeing the safety of media workers, and developing proposals for their improvement. It determined the accomplishment of such objectives as: - revealing theoretical and legal approaches to defining the status of a journalist and a «media participant» in the conditions of an armed conflict; - analyzing the compliance of national legislation with international regulatory standards for the protection of journalists and other media workers in war conditions; - investigating the typology and dynamics of socially dangerous encroachments against journalists and the legal order of journalistic activity before and after February 24, 2022; - evaluating the real state of pre-trial investigation of criminal offenses related to journalistic activity using the method of comparative statistical analysis; - conducting a survey of media community representatives regarding the effectiveness of security measures and other guarantees of the legal status of journalists in the conditions of a full-scale Russian-Ukrainian war. The theoretical and practical value of the innovative project lies in the comprehensive systematization of legal collisions in the legislation of Ukraine

7 regarding the social protection of media workers. The formulated proposals for amending the Order of the Commander-in-Chief of the Armed Forces of Ukraine No. 73 and the Resolution of the Cabinet of Ministers of Ukraine No. 776 can be used to improve the regulatory framework for the activities of journalists in the combat zone. The scientific novelty of the presented research lies in the substantiation of the need to introduce the status of a «war correspondent» in Ukraine in accordance with the Third Geneva Convention to ensure the status of a prisoner of war (POW) in case of capture. The study also proves the inefficiency of the existing accreditation system for ensuring physical safety and identifies the «identification paradox» where standard «PRESS» markings serve as a target rather than protection in the context of Russian aggression.
