Abstract

Об’єктом кваліфікаційної роботи є суспільні відносини, що пов’язані з реалізацією права на мирні зібрання та його правова охорона. Предметом кваліфікаційної роботи є захист прав осіб при здійсненні особистого немайнового права на мирні зібрання. Проблематика мирних зібрань завжди була, є та, безперечно, залишатиметься актуальною як з теоретичної, так і з практичної точок зору. І це зрозуміло, оскільки мирні зібрання є не лише критерієм, за яким визначається рівень демократії в країні, а й надзвичайно дієвим способом громадського контролю за інститутами публічної влади. Варто згадати також і про те, що мирні зібрання подекуди є засобом реалізації ряду інших прав приватних осіб – права громадянина на свободу світогляду і віросповідання, думки й слова, на вільне вираження своїх поглядів та переконань, на використання і поширення інформації усно, письмово або в інший спосіб на свій вибір, права на вільний розвиток своєї особистості тощо. Мета роботи полягає у встановленні сутності та особливостей провадження у справах щодо реалізації права на мирні зібрання, його правового регулювання та теоретичного забезпечення, а також визначення напрямків їх подальшого удосконалення.
