Правовий статус юридичної служби органу місцевого самоврядування в Україні

Abstract

UA : Кваліфікаційна робота складається зі 112 сторінок, містить 74 джерела використаної інформації. В умовах становлення демократичної правової державності об’єктивно посилюються тенденції до децентралізації публічної влади, а це напряму є пов’язаним з активним розвитком інституту місцевого самоврядування, що виступає як самоорганізація жителів відповідних територій держави, які об’єднані в територіальні громади, з метою вирішення питань місцевого значення на основі Конституції України та її законів. Поява інституту локальної демократії на теренах посттоталітарної держави стало воістину революційною подією, бо вперше на конституційному рівні держава визнала як сам територіальний суб’єкт в особі територіальної громади, так й наявність колективних інтересів у такого територіального суб’єкта, що не тільки не співпадають з державними інтересами, але й їм не суперечать. Більш того, закріплення інституту місцевого самоврядування в якості конституційного інституту, по-перше, знаменувала його включення до переліку об’єктів конституційно-правового регулювання і, по-друге, до засад конституційного устрою держави, що означає не тільки особливу значущість для держави суспільних відносин, що виникають, існують, розвиваються та реалізуються у сфері локальної демократії, але й високий рівень їх легалізації і легітимації, що детермінує високі вимоги до дотримання законодавства в сфері діяльності суб’єктного складу місцевого самоврядування і, насамперед, територіальної громади та сформованих нею органів – органів місцевого самоврядування. Саме в цих умовах стає зрозумілою об’єктивізація і актуалізація особливої ролі і значення юридичної Служби. Мета кваліфікаційної роботи полягає у дослідженні правового статусу юридичної служби, органу місцевого самоврядування в Україні. Об’єктом дослідження є суспільні відносини, що виникають у сфері становлення, розвитку та діяльності юридичної служби в органах місцевого самоврядування Україні. Предмет є правовий статус юридичної служби в органах місцевого самоврядування України. Методологічну основу роботи складають сукупність філософсько-світоглядних, загальнонаукових принципів і підходів та спеціально-наукових методів пізнання конституційно-правових явищ, використання яких дало змогу отримати науково-обґрунтовані результати. Для проведення дослідження будуть застосовані такі загальнонаукові методи як: аналіз і синтез. Теоретико-методологічною основою дослідження в роботі є історичний метод та метод матеріалістичної діалектики, застосування яких сприяло розглянути всі процеси в розвитку органів місцевого самоврядування.

In the conditions of becoming democratic legal statehood, tendencies towards decentralization of public power are objectively increasing, and this is directly related to the active development of the institution of local self-government, which acts as a self-organization of the residents of the respective territories of the state, united in territorial communities, with a view to solving issues of local importance based on the Constitution of Ukraine and its laws. The emergence of the institution of local democracy in the territory of a post-totalitarian state became a truly revolutionary event, because for the first time at the constitutional level the state recognized both the territorial entity itself in the person of the territorial community, and the presence of collective interests in such a territorial entity that not only do not coincide with the state ones. interests, but they do not contradict either. Moreover, the consolidation of the institution of local self-government as a constitutional institute, first, marked its inclusion in the list of objects of constitutional regulation and, secondly, in the principles of the constitutional structure of the state, which means not only special importance for the state of public relations. emerging, existing, developing and implemented in the field of local democracy, but also their high level of legalization and legitimation, which determines the high requirements for compliance with the legislation in the field of activity of the subject system of local government and, above all, the local community and its existing authorities - local authorities. The purpose of the qualification work is to study the legal status of a legal service, a local government body in Ukraine. The object of the study is the social relations that arise in the sphere of formation, development and activity of the legal service in the local self-government bodies of Ukraine. The subject is the legal status of the legal service in the local self-government bodies of Ukraine. The methodological basis of the work consists of a set of philosophical and ideological, general scientific principles and approaches and special-scientific methods of knowledge of constitutional and legal phenomena, the use of which has enabled to obtain scientifically substantiated results. For research, the following general scientific methods such as: analysis and synthesis will be applied. The theoretical and methodological basis of the study in the work is the historical method and the method of materialistic dialectics, the use of which contributed to consider all the processes in the development of local self-government.
