Територіальний устрій України: особливості конституційно-правого регулювання в сучасних умовах євроінтеграції

Abstract

UA : Кваліфікаційна робота складається зі 85 сторінок, містить 85 джерел використаної інформації. Становлення демократичної моделі організації публічної влади в Україні зумовлює необхідність удосконалення територіального устрою. У сьогоднішніх реаліях ідея реформування територіального устрою Української держави та впровадження ефективної організаційної структури державної влади привертає дедалі більшу увагу науковців, політиків та громадськості. Адже ключові ідеї доктрини організації території держави, як свідчить історичний досвід, мали визначальний вплив на вчення про державу, як інституційну систему організації публічної влади, способи і форми її організації в демократичному суспільстві та функціонування політичної системи загалом. Об’єктом дослідження є правові відносини, які виникають у процесі застосування принципів територіального устрою України. Предметом дослідження є територіальний устрій України: особливості конституційно-правового регулювання в сучасних умовах євроінтеграції. Метою кваліфікаційної роботи є дослідження конституційно-правової сутності територіального устрою України, визначення структури та змісту інституту територіального устрою України. Методологічною основою дослідження є загальнонаукові та спеціальні методи пізнання. Зокрема, за допомогою діалектичного методу принципи територіального устрою України розглядаються у взаємозв’язку і взаємозалежності. Використання системного та структурного методів дозволило дослідити територіальний устрій як державно-правове явище, розкрити зміст кожного із принципів територіального устрою окремо, класифікувати ці принципи за рівнем закріплення у нормативно-правових актах, проаналізувати впровадження конституційних принципів територіального устрою України в державно-правову практику, виявити проблеми їх реалізації та запропонувати рекомендації щодо вдосконалення їх практичного втілення. Історико-правовий метод дав змогу дослідити становлення та розвиток інституту принципів територіального устрою України у конституційному процесі України. Порівняльно-правовий метод застосовано для аналізу та порівняння положень Конституції України з Основними Законами зарубіжних держав, положеннями міжнародних правових актів, які є обов’язковими для виконання Україною. У дослідженні застосовано також методи збору інформації, аналізу, синтезу, аналогії при вивченні документів; метод узагальнення використано при підготовці висновків.

The formation of a democratic model of organization of public authority in Ukraine necessitates the improvement of the territorial system. In today's realities, the idea of reforming the territorial structure of the Ukrainian state and introducing an effective organizational structure of state power is attracting increasing attention from scholars, politicians and the public. After all, the key ideas of the doctrine of organization of the territory of the state, as evidenced by historical experience, had a decisive influence on the doctrine of the state as an institutional system of organization of public power, ways and forms of its organization in a democratic society and the functioning of the political system as a whole. The object of the study is the legal relations that arise in the process of applying the principles of territorial organization of Ukraine. The subject of the study is the territorial structure of Ukraine: features of constitutional and legal regulation in modern conditions of European integration. The purpose of qualification work is to study the constitutional and legal nature of the territorial structure of Ukraine, to determine the structure and content of the institute of territorial structure of Ukraine. The methodological basis of the research is general scientific and special methods of cognition. In particular, through the dialectical method, the principles of territorial structure of Ukraine are considered interconnected and interdependent. The use of systemic and structural methods allowed to explore the territorial system as a state-legal phenomenon, to reveal the content of each of the principles of territorial structure separately, to classify these principles by the level of consolidation in normative legal acts, to analyze the implementation of the constitutional principles of territorial structure of Ukraine in the state-legal practice. problems of their implementation and offer recommendations for improving their practical implementation. The historical and legal method made it possible to study the formation and development of the Institute of the principles of territorial structure of Ukraine in the constitutional process of Ukraine. The comparative legal method is applied to analyze and compare the provisions of the Constitution of Ukraine with the Basic Laws of foreign states, the provisions of international legal acts that are binding on Ukraine. The study also applied methods of information gathering, analysis, synthesis, analogy when studying documents; the method of generalization was used in drawing conclusions.
