Запобігання та врегулювання реального конфлікту інтересів на державній службі за законодавством України

Abstract

UA : Кваліфікаційна робота складається зі 100 сторінок, містить 85 джерел використаної інформації. Актуальність дослідження питання запобігання та врегулювання реального конфлікту на державній службі в Україні зумовлена зростаючим рівнем суспільних вимог до органів влади; потребами подальшого інституційного розвитку державної служби; закріпленням принципів громадянського служіння державі й суспільству, етичних норм виконання посадових обов’язків. З огляду на очевидне бажання України стати рівноправним членом міжнародного співтовариства зроблено висновок про необхідність вивчення та втілення в життя зарубіжного досвіду, насамперед діючих у розвинених демократичних країнах політичних, організаційних і правових механізмів запобігання та подолання негативних наслідків конфлікту інтересів на державній службі. Реальний конфлікт інтересів заслуговує на більшу увагу. Саме цей вид загострює ефективну роботу всієї державної служби, врегулювання його в окремих випадках уже потребує залучення зовнішнього контролю та в ході позбавлення від реального конфлікту інтересів особи можуть бути притягнуті до відповідальності. Метою кваліфікаційної роботи є визначення змісту поняття «запобігання та врегулювання реального конфлікту інтересів на державній службі» на підставі аналізу наявних наукових та нормативних джерел, дослідження особливостей правового регулювання в чинному законодавстві України всіх структурних елементів механізму запобігання та врегулювання конфлікту інтересів, окреслення проблем, які існують у зазначених сферах, та формулювання пропозицій щодо вдосконалення нормативно-правового регулювання запобігання та врегулювання конфлікту інтересів. Об’єктом дослідження даної кваліфікаційної роботи є суспільні відносини, які виникають під час запобігання та врегулювання реального конфлікту інтересів на державній службі. Предметом дослідження є запобігання та врегулювання реального конфлікту інтересів на державній службі. Методологічну основу роботи складають сукупність філософсько-світоглядних, загальнонаукових принципів і підходів та спеціально-наукових методів пізнання адміністративно-правових явищ, використання яких дало змогу отримати науково-обґрунтовані результати. Для проведення дослідження будуть застосовані такі загальнонаукові методи як: аналіз і синтез. Теоретико-методологічною основою дослідження в роботі стала сукупність методів і прийомів наукового пізнання, як загальнонаукових (діалектичний, формально-юридичний, історичний, логіко-семантичний, системний аналіз тощо), так і спеціальних (документального аналізу, порівняльно-правовий тощо).

EN : A thesis consists of 100 pages and contains 85 sources of information used. The relevance of research concerning the issue of preventing and settling the real conflict in the civil service in Ukraine is conditioned by the increasing level of public demands to the authorities; needs for further institutional development of the civil service; the consolidation of the principles of civil service to the state and society, ethical standards of official duties performance. Taking into consideration Ukraine's obvious desire to become an equal member of the international community it was concluded that foreign experience should be studied and brought to realization. First of all, political, organizational and legal mechanisms for preventing and overcoming the negative effects of conflicts of interest in the civil service in the developed democratic countries should be applied. The real conflict of interest deserves more attention. This type of conflict exacerbates the effective functioning of the entire civil service, and, in some cases, its settlement requires the involvement of external control, and individuals may be held liable in the course of getting rid of a real conflict of interest. The thesis' purpose is to determine the concept of "prevention and settlement of the real conflict of interest in the civil service" on the basis of available scientific and reference sources analysis, to study the peculiarities of legal regulation of all structural elements of prevention and settlement of the conflict of interest in Ukrainian current legislation, to identify problems that exist in these areas, and to formulate proposals for improving the legal and regulatory environment of prevention and settlement of the real conflict of interest. The thesis' object is the public relations that arise during the prevention and settlement of the real conflict of interest in the civil service. The subject of the study is the prevention and settlement of the real conflict of interest in the civil service. The methodological basis of the work consists of philosophical, general scientific principles and approaches and special scientific methods of knowledge of administrative phenomena, that allowed to obtain scientifically-based results. Such general scientific methods will be applied for the study: analysis and synthesis. A set of methods and techniques of scientific knowledge, both general (dialectical, technical, historical, logical-semantic, system analysis, etc.), and special (documentary analysis, comparative-legal studies, etc.) became the theoretical and methodological basis of the thesis.
