Інститут конституційної скарги в Україні: європейський досвід та українські реалії

Abstract

UA : Кваліфікаційна робота складається зі 109 сторінок, містить 71 джерело використаної інформації. Демократичний розвиток держави передбачає вдосконалення форм та методів захисту прав і свобод людини і громадянина, в тому числі і органом конституційної юстиції, а інститут конституційної скарги в Україні запроваджено порівняно нещодавно, а тому він безперечно потребує доопрацювань та вдосконалень з метою підвищення рівня його ефективності. Як показує зарубіжний досвід, важливість даного інституту в механізмі забезпечення прав людини є незаперечною і саме це зумовлює актуальність обраної теми та необхідність проведення глибокого аналізу інституту конституційної скарги як в нашій державі, так і в зарубіжних країнах і вироблення на основі цього рекомендацій та пропозицій щодо вдосконалення законодавства, яке регулює даний інститут. Метою кваліфікаційної роботи є комплексний аналіз правового регулювання інституту конституційної скарги в Україні та у окремих зарубіжних країнах (ФРН, РП та інші), а також з’ясування особливостей його функціонування в названих країнах, визначення кола проблем правового регулювання інституту конституційної скарги в Україні та пошук способів їх вирішення. Об’єктом дослідження даної кваліфікаційної роботи є суспільні відносини в сфері захисту прав, свобод та законних інтересів людини і громадянина. Предметом дослідження є інститут конституційної скарги в Україні та в зарубіжних державах. Методологічнуоснову роботи складають сукупність філософсько-світоглядних, загальнонаукових принципів і підходів та спеціально-наукових методів пізнання конституційно-правових явищ, використання яких дало змогу отримати науково-обґрунтовані результати. Для проведення дослідження будуть застосовані такі загальнонаукові методи як: аналіз і синтез. Теоретико-методологічною основою дослідження в роботі є порівняльно-правовий та історичний методи, а також метод матеріалістичної діалектики, застосування яких сприяло розглянути всі процеси щодо розвитку інституту конституційної не виокремлено, а в тісному зв’язку і взаємозалежності з історичним розвитком правової системи України та зарубіжних держав, всіх соціальних явищ, що справили вплив на формування інституту конституційної скарги в Україні.

EN : Qualifying work consists of 110 pages, contains 71 sources of information used.The democratic development of the state envisages improvement of the forms and methods of protection of human and citizen's rights and freedoms, including the body of constitutional justice, and the institute of constitutional complaint in Ukraine was introduced recently, and therefore it definitely needs to be refined and improved in order to improve it. Foreign experience shows that the importance of this institution in the mechanism of human rights protection is indisputable, and this makes the topicality of the chosen topic and the need to conduct a thorough analysis of the constitutional complaint institute in our country as well as in foreign countries and to make recommendations and suggestions for improvement on the basis of this legislation governing this institute. The purpose of the qualification work is a comprehensive analysis of the legal regulation of the institution of constitutional complaint in Ukraine and in some foreign countries (Germany, the Republic of Poland and others), as well as to clarify the peculiarities of its functioning in these countries, identify the range of problems of legal regulation of the institution of constitutional complaint in Ukraine and search ways to solve them. The subject of study of this qualification work is public relations in the field of protection of rights, freedoms and legitimate interests of the individual and the citizen. The subject of the research is the institute of constitutional complaint in Ukraine and in foreign countries. The methodological basis of the work is a set of philosophical, philosophical, general scientific principles and approaches and specially-scientific methods of knowledge of constitutional and legal phenomena, the use of which has allowed to obtain scientifically sound results. For the study will be applied such general scientific methods as: analysis and synthesis. The theoretical and methodological basis of the study in the work is comparative legal and historical methods, as well as the method of materialistic dialectics, the use of which contributed to consider all processes for the development of the constitutional institution not in isolation, but in close connection and interdependence with the historical development of the legal system of Ukraine and foreign states, all social phenomena that influenced the formation of the constitutional complaint institute in Ukraine.
