Права та обов’язки оперативних підрозділів в умовах трансформації системи суб’єктів протидії злочинів в Україні

Abstract

UA : Кваліфікаційна робота складається зі 101 сторінки, містить 77 джерел використаної інформації.Актуальність цієї проблеми підвищується у зв’язку з непоодинокими випадками порушень вимог закону працівниками оперативних підрозділів при здійсненні своїх повноважень, і особливо при здійсненні ними негласних слідчих (розшукових) дій (далі – НСРД). Крім того, специфічність діяльності оперативних підрозділів є в тому, що вони є державним органом на який покладено здійснення державної політики у сфері боротьби зі злочинністю та здійснення кримінального переслідування осіб, які вчинили кримінальне правопорушення. Мета роботи полягає в комплексному аналізі та детальному дослідженні норм кримінального процесуального законодавства, щодо особливостей реалізації оперативними підрозділами їх повноважень. Об’єктом кваліфікаційної роботи є суспільні відносини, які виникають між оперативними підрозділами та іншими суб’єктами кримінального процесу під час реалізації ними своїх повноважень. Предметом дослідження є норми кримінального процесуального та іншого законодавства, які встановлюють основи діяльності оперативних підрозділів, їх права та обов’язки.

In addition, the specificity of the operations of the operational units is that they are a state body charged with the implementation of state policy in the field of crime and criminal prosecution of persons who have committed a criminal offense. But alas, we cannot claim that such exclusive powers of the operational units have made it possible to at least reduce the crime rate in the country. On the contrary, we observe a very high level of crime, characterized by cruelty and arrogance. The reform process also touched upon the activities of operational units that assist the investigator in establishing objective truth in the pre-trial investigation, precisely because their activity is related to the conduct of operational-search and silent investigative (investigative) actions that may violate citizens' constitutional rights and freedoms . The urgency of this problem is increased due to the frequent cases of violations of the requirements of the law by the employees of the operational units in the exercise of their powers, and especially in the performance of their unspoken investigative (investigative) actions (hereinafter – NSD). In addition, the specificity of the operations of the operational units is that they are a state body charged with the implementation of state policy in the field of crime and criminal prosecution of persons who have committed a criminal offense. The purpose of the work is a comprehensive analysis and detailed study of the rules of criminal procedural legislation, as to the peculiarities of implementation by operational units of their powers. The object of qualification work is the social relations that arise between operational units and other subjects of criminal proceedings in the course of exercising their powers.
