Діяльність судових органів України з реалізації та захисту прав, свобод та обов’язків людини і громадянина

Abstract

UA : Кваліфікаційна робота складається зі 102 сторінок, містить 82 джерела використаної інформації. Суди всіх інстанцій (першої, апеляційної, касаційної), мають належним чином виконувати свої обов’язки із забезпечення реалізації прав та свобод людини і громадянина, мають здійснювати їх захист шляхом всебічного та об'єктивного розгляду справ за зверненням громадян у разі їх порушення. Суди зобов’язані захищати права та свободи людини і громадянина, дотримуючись норм матеріального права із дотриманням норм процесуального права. Об’єктом дослідження наукової роботи є саме судовий захист прав і свобод людини і громадянина як правове явище. Предметом дослідження наукової роботи є діяльність судових органів України з реалізації та захисту прав, свобод та обов’язків людини і громадянина. Метою дослідження магістерської роботи є ознайомлення із діяльністю судових органів України з реалізації та захисту прав, свобод та обов’язків людини і громадянина та вирішення проблем, які стосуються судової діяльності. Завданнями дослідження наукової роботи є: - ознайомлення із загальною характеристикою діяльності судових органів України з реалізації та захисту прав, свобод та обов’язків людини і громадянина; - здійснити аналіз судового захисту прав і свобод людини і громадянина; - встановлення та дослідження проблем, які стосуються діяльності судових органів України з реалізації та захисту прав, свобод та обов’язків людини і громадянина; - порівняння міжнародних стандартів судового захисту прав і свобод людини та їх імплементація в систему правозахисту в Україні; - дослідження судової практики щодо захисту прав та свобод людини і громадянина та практики Європейського суду з прав людини у контексті здійснення судочинства в Україні. Методологічну основу кваліфікаційної роботи складає дослідження діяльності органів правосуддя з питань захисту прав, свобод і обов’язків людини і громадянина. Теоретико-методологічною основою дослідження даної роботи є практичний метод, який під час свого застосування, дозволив пізнати та дослідити діяльність судових органів України з питань захисту прав, свобод і обов’язків людини і громадянина.

EN : Qualification work consists of 102 pages, contains 82 sources of information used. Courts of all instances (first, appellate, cassation) must properly perform their duties to ensure the realization of human and civil rights and freedoms, must protect them by comprehensive and objective consideration of cases at the request of citizens in case of violation. Courts are obliged to protect the rights and freedoms of man and citizen in accordance with the rules of substantive law in compliance with the rules of procedural law. The object of study of scientific work is the judicial protection of human and civil rights and freedoms as a legal phenomenon. The subject of research is the activities of the judicial authorities of Ukraine to implement and protect the rights, freedoms and responsibilities of man and citizen. The purpose of the master's thesis is to get acquainted with the activities of the judicial authorities of Ukraine to implement and protect the rights, freedoms and responsibilities of man and citizen and solve problems related to judicial activity. The objectives of the research work are: - acquaintance with the general characteristic of activity of judicial bodies of Ukraine on realization and protection of the rights, freedoms and duties of the person and the citizen; - to analyze the judicial protection of human and civil rights and freedoms; - identification and research of problems related to the activities of judicial bodies of Ukraine for the implementation and protection of human and civil rights, freedoms and responsibilities; - comparison of international standards of judicial protection of human rights and freedoms and their implementation in the human rights system in Ukraine; - study of judicial practice on the protection of human and civil rights and freedoms and the practice of the European Court of Human Rights in the context of the administration of justice in Ukraine. The methodological basis of the qualification work is a study of the activities of the judiciary on the protection of rights, freedoms and responsibilities of man and citizen. The theoretical and methodological basis of the study of this work is a practical method, which during its application, allowed to learn and explore the activities of the judicial authorities of Ukraine on the protection of human rights, freedoms and responsibilities.
