Об'єктом дослідження є суспільні відносини, які виникають при належному регулюванні відносин за шкоду, заподіяну фізичній особі, яка є жертвою кримінальних правопорушень. Предметом дослідження є інститут відшкодування шкоди фізичній особі як жертві кримінального правопорушення. Курс України спрямований на захист прав людини, але потерпілі від кримінальних правопорушень залишаються поза увагою. У той час як інші держави мають розгалужену та багаторівневу систему гарантування та захисту прав та інтересів потерпілих, в Україні немає спеціального закону щодо захисту прав та законних інтересів потерпілих, а діючі нормативні положення винятково зводяться до процесуальних. Не існує і постійних стандартів поведінки для правоохоронних органів з ними, фактично не існує інституту державної компенсації за кримінальне правопорушення шкоди. Тому ці питання потребують вирішення та є надзвичайно актуальними та потребують подальшого дослідження та вирішення.
EN : The work is set out on 108 pages of printed text, contains 72 sources of information used. The object of the research is public relations, which arise in the proper regulation of the relations for damages caused to the physical person, which are the victims of criminal offenses. The subject of the research is the Institute of Indemnification for Damage to a Physical Person, as a Victim of Criminal Offense. The course of the State of Ukraine is directed to the protection of human rights, but the victims of criminal offenses are left behind by their attention. While other states have an extensive and multilevel system of guaranteeing and protecting the rights and interests of victims of criminal offenses, in Ukraine there is no specific law to protect the rights and legitimate interests of victims, and the current regulatory provisions are reduced mainly to procedural ones. There are no and permanent standards of behavior of law enforcement agencies with them, in fact there is no institution of state compensation for criminal offense of harm. Therefore, these issues need to be addressed and are extremely relevant and need further investigation and resolution.
