UA : Кабінет міністрів України затвердив Державну стратегію регіонального розвитку на період до 2020 року. Стратегія визначає цілі державної регіональної політики та основні завдання центральних та місцевих органів виконавчої влади і органів місцевого самоврядування, спрямовані на досягнення зазначених цілей, а також передбачає узгодженість державної регіональної політики з іншими державними політиками, які спрямовані на територіальний розвиток.
Уряд визначив підтримку реформи децентралізації в Україні одним з пріоритетних завдань, що сприятиме розвитку місцевого самоуправління і економічного розвитку країни в цілому.
Розбудова сучасної системи місцевого самоврядування, зокрема шляхом консолідації територіальних громад, на принципах децентралізації повноважень, субсидіарності, деконцентрації ресурсів, гармонізації загальнодержавних, регіональних та місцевих інтересів потребує дальшого вдосконалення чинного законодавства та комплексних підходів до вирішення актуальних питань забезпечення життєдіяльності об’єднаних територіальних громад у всіх сферах суспільного життя.
Об’єктомроботи є суспільні відносини, в сфері децентралізації публічної влади.
Предметом роботи єконституційно-правовий механізм добровільного об’єднання територіальних громад в умовах децентралізації публічної влади.
Метоюдослідження комплексне дослідження та детальний аналіз конституційно-правового механізмудобровільного об’єднання територіальних громад в умовах децентралізації публічної влади.
Методологічну основу роботи складають загально-наукові принципи і підходи та спеціально-наукові методи пізнання, що дають змогу ясніше усвідомити сутність та проблематику кваліфікаційної роботи.
Сформульовано висновок про те, що подальше реформування конституційних основ місцевого самоврядування та утвердження проєвропейської моделі місцевого самоврядування в Україні потребує реалізації потенціалу локальної демократії та законодавчого забезпечення її основних форм і видів з урахуванням позитивного досвіду розвитку місцевого народовладдя в державах-учасницях ЄС. Це значить, що нагальним завданням законодавця на сьогодні є прийняття законів України «Про місцеві референдуми» та «Про форми місцевої демократії».
EN : The Cabinet of Ministers of Ukraine approved the State Strategy for Regional Development for the period up to 2020. The object of work is public relations, in the sphere of decentralization of public power.
The subject of the work is the constitutional and legal mechanism of voluntary unification of territorial communities in the conditions of decentralization of public power.
The purpose of the study is a comprehensive study and detailed analysis of the constitutional and legal mechanism of voluntary association of territorial communities in the conditions of decentralization of public power.
The methodological basis of the work is the general scientific principles and approaches and the special scientific methods of cognition, which make it possible to become more aware of the nature and problems of qualification work.
The conclusion is formulated that further reform of the constitutional foundations of local self-government and the establishment of a pro-European model of local self-government in Ukraine requires the realization of the potential of local democracy and legislative support for its basic forms and types, taking into account the positive experience of local government development in the EU member states. This means that the urgent task of the legislator today is to pass laws of Ukraine “On Local Referenda” and “On Forms of Local Democracy”.
