UA : Об’єктом дослідження є регуляторна політика ЄС у сфері телекомунікацій.
Предмет дослідження – директиви ЄС в контексті впровадження зв’язку 5 покоління.
Мета кваліфікаційної роботи – дослідити правове регулювання ЄС у сфері швидкого розвитку телекомунікацій.
Виходячи з мети, поставлені наступні завдання:
1) Дослідити методологічні засади досліджуваної теми;
2) Проаналізувати інституційний розвиток регулювання телекомунікаційної сфери ЄС;
3) Дослідити розподіл повноважень між центральними органами та країнами-членами ЄС у сфері телекомунікацій та зв’язку
4) Систематизувати знання щодо історії впровадження бездротових телефонних технологій і мобільних телекомунікацій;
5) Дослідити впровадження зв'язку 5 покоління та його відображення у регуляторній політиці ЄС.
Хронологічні межі – 1980-2020 – нижня межа: Договір про Європейські Спільноти, а саме ст. 154, де йдеться про те, що Спільнота сприятиме створенню та розвитку транс'європейських мереж у транспортній, телекомунікаційній та енергетичній інфраструктурі; верхня межа європейський кодекс електронних комунікацій, щодо умов розгортання 5G у всієї спільноти, а саме етап його реалізації.
Новизна роботи полягає у структуризації отриманих в результаті кваліфікаційної роботи інформації щодо регуляторної політики Європейського Союзу у сфері телекомунікації в контексті впровадження зв’язку 5 покоління; систематизація нормативної та законодавчої бази ЄС у сфері телекомунікації, та подальшому використанні отриманих результатів в дослідженнях регуляторної політики у сфері телекомунікацій ЄС, аналізі можливостей впливу на телекомунікаційну сферу завдяки державних органів, та подальшому вивченні розвитку технологій зв’язку.
Висновки. Сучасний світ дійсно перебуває на перехідному етапі від індустріального суспільства до інформаційного. Звичайно головною рушійною силою на цьому етапі виступають зміни у сфері телекомунікацій та зв’язку, бо саме ці процеси передачі, отримання та обробки інформації на різні відстані із застосуванням мережевих технологій слугують двигуном економічної революції.
Етап розвитку телекомунікацій на території ЄС відбувався досить довго, й навіть незважаючи на розуміння важливості розвитку галузі та її економічної ефективності, наявності плану дій ЄС, розроблених e-Europe, е-Уряд, виступів вчених та науковців, не призвели до вдалого регулювання ринку на початку його формування, можливо через відсутність розуміння компетенції ЄС у цьому процесі.
До створення BEREC, та НРО одними з компетентних регуляторів ЄС у сфері телекомунікацій та зв’язку стали комісар ЄК та Генеральний директорат з комунікаційних мереж, контенту та технологій та європейський комісар з питань конкуренції, які накладали штрафи на європейські та міжнародні компанії, задля запобіганню монополізації ринка.
Поява 5G дарує світу низку технічних переваг, такі як пікова швидкість передачі даних у розмірі 20Гбіт / с., тобто майже у 20 разів більше ніж 4G LTE; не менше 1 мільйона підключених пристроїв на квадратний кілометр, які знаходяться поблизу станції або вишки; мобільність пересування майже до 500 км / год, у той час коли 4G – 120 км / год.; можливість економити енергії через функцію так званого «сплячого режиму» станції; спектральна ефективність; та мінімальна затримка до 1 мс. Все це відкриває шляхи до технологічного майбутнього.
Основний акцент на регуляцію телекомунікаційних мереж робиться щодо рівного доступу гравців ринку, спільного інвестування у нові високошвидкісні мережі та розподілу ризиків при побудові нових мереж, стійкої конкуренції через нові правила симетричного регулювання а також ретельний нагляд зі стороні ЄК та BEREC з метою гарантування та посилення внутрішнього ринку та створення у майбутньому єдиного цифрового європейського ринку.
EN : The research relevance. Information and telecommunication technologies in the modern world are an important engine of economic progress and modernization of almost all spheres of life. Today, the world is in the transition from an industrial to an information society. Of course, this is due to the rapid changes and revolutions in information technology and telecommunications, namely in the context of the introduction of fifth generation communications. These changes affect not only the technical component but also directly affect everyone's life. New telecommunication networks improve the population's access to information, allow people to find the right answer to any question in an extremely short time, involve ordinary people in making important decisions at the state level, and creating new jobs. New technologies are also paving the way for a new, unexplored future: high-speed transportation systems, smart homes, the Internet of Things, and more. That is why the construction of a new open information society is impossible without introducing a new generation of communication, which would allow using this potential to the maximum, and without perfect legal regulation, within the framework of the European legislation. Today, one large IT company can replace a plant with a thousand of workers in terms of profitability. "Digital diplomacy" is already an important brand tool and a means of developing negotiations between states. The introduction of fifth generation communication has both positive and negative sides. Many utopians and scholars believe that comprehensive digitalization will lead to a complete control of all spheres of life online; on the other hand, it will reduce the amount of offences, murders and criminal cases in general. Today, large holdings in Europe have won frequency auctions to introduce fifth-generation communications and have spent billions of euros to achieve this goal. That is why the European Union, as an important international referee, needs to develop a current policy for the introduction of a new powerful engine and regulate access to this independent structure to prevent the monopolization of elites.
Ukraine’s modern foreign policy is closely linked to European integration in all areas, including those in the context of information and communication technologies. Today, Ukraine is one of the leading countries that offer the best IT professionals and is in demand for projects in information and communication systems. Ukrainian specialists are already joining the implementation of the leading products of the future, such as the state in the smartphone, transparently, etc. Our specialists work in the world's top companies: YouTube, Facebook, Google, Twitter, implement their projects, help digitalize all spheres of life and automate any process, both in industry and IT as well as in our ordinary daily lives and service areas. However, due to the lack of a perfect legal framework, Ukraine cannot fully realize its IT potential, and by the Law of Ukraine "On the National Program for Adaptation of the Ukrainian Legislation to the Legislation of the European Union", it is important for us to adopt the national legislation to the European Union criteria in full for the implementation of domestic and foreign policy.
The research object is the EU regulatory policy in the field of telecommunications.
The research subject is the EU directives in the context of the introduction of fifth generation communication.
The aim of the research is to explore the legal regulation of the EU in the field of rapid development of telecommunications.
For achieving the above set goals, we are to fulfill the following specific research objectives:
1) to investigate the methodological principles of the research topic;
2) to analyze the EU regulatory policy in the field of telecommunications;
3) to research the history of the telecommunications emergence in the European space;
4) to systematize the knowledge of the EU legal framework in the field of telecommunications;
5) to explore the directives as a means of the EU regulatory policy in the implementation of fifth generation communications.
Conclusions. The modern world is really in the transition from an industrial society to an information one. Of course, the main driving force is a change in telecommunications and communications as it is these processes of transmitting, receiving, and processing information over different distances using network technologies that serve as the engine of the revolution.
From the 1950s to the 1990s, various technologies were developed and created in telecommunications, from satellite and advanced cable systems to digital and fiber-optic technology and video communication. The communications industry has been fully computerized in recent decades.
It was at this time that the geopolitical player, the European Union, began to take shape. The formation of the EU was completed when the Maastricht Treaty was signed in 1992. Therefore, the European Union, as a supranational body, needed to develop a good legal and regulatory framework in order not to hinder the development of telecommunications and communications technologies, and at the same time to act as a judge in the event of market conflicts and equal distribution of state radio frequencies and strategy objectives according to the liberal economic rules of the game.
The history of the EU's creation and transformation of its institutional structure is more than a decade old. Of course, the main governing bodies remained the same: the European Commission, the European Parliament, the EU Council, and the European Court of Justice. But the formation of new regulators in narrow economic spheres is an example of expertise and that for imitating European law and developing a legal framework for successful state regulation of various sectors of the economy. The Union's main goal, which has also remained unchanged, is to overcome the obstacles to integration, find the right solutions and implement them. In telecommunications and communications, the EU aims to create a single digital space, which will be regulated by NRAs and BEREC.
The history of telecommunication integration of the EU countries is the embodiment of development programs and concepts to eliminate barriers and inequalities between the countries. It dates back to the negotiations in Maastricht, as it was mentioned above. This treaty formed and declared the Acquis communautaire (from French "community property"), a legal concept in the system of legal norms of the European Union. This means that the set of different principles, rules, and norms adopted within the EU are subject to mandatory preservation, development and implementation in the member states' legislation.
Thus, between 2000 and 2010, the EU aimed to create a new, essentially e-technology government and a new intellectual society that would use the potential of new and leading telecommunications networks. To this end, the European Commission had to ensure the legislative implementation related to the electronic and telecommunications sectors. A special role in building a successful legal framework was played by the Barrozo Commission and, separately, by Viviane Reding, Commissioner for Information Society and Media. It was her, one of the first specialists to find herself in this newly created position and try to initiate a package of laws that would regulate copyright and stop the so-called "piracy" via the Internet which costs about 20 million euros a year. The telecommunications package covers a wide range of issues, from dissemination of information through radio and television channels to creating a pan-European regulatory body that protects the confidentiality of user information. In a broad sense, the law is designed to ensure a single telecommunications market for the EU. The main mission of the European Commissioner for Digital Economy and Society, in addition to monitoring and implementing measures on the sphere of influence, is also to promote legislative initiatives and proposals for the creation of a common telecommunications market; assessment of the main obstacles to the implementation of the idea; development of privacy policy measures; promoting job creation in Europe; deployment of a quality Internet and communication network; support and promotion of creative industries and stable business models; support for the fundamental rights and freedoms of a European man; consideration of problems related to Internet platforms and control of new virtual markets; promotion of the latest technologies, such as the Internet of Things, etc., the promotion of Internet entrepreneurship; creation of e-government, as well as assistance in developing the EC as a more open and efficient administrative body through the use of IT solutions. Thus, initially, in the field of telecommunications and communications, the EC Commissioner and the Directorate-General for Communications Networks, Content and Technology, which is the responsibility of the European Commissioner for Digital Economy and Society, played an important role. Their competence was to develop the directives and monitor the implementation of decisions taken by the Council and the European Parliament. They were, in fact, the bodies of regulatory policy.
When we see the letter "G", it means "generation" built based on the technology, for instance the first generation technology. In the 1980s, no one thought about data services and used the phone only for voice calls and other undeveloped features. But later technologies began to appear, such as GSM – the first global mobile communication system, General Packet Radio Service (GPRS), UMTS (Universal Mobile Telecommunications System), CDMA2000, EDGE (Enhanced Data-rates for GSM Evolution), IMT-Advanced (International Mobile Telecommunications-Advanced) and IMT-2020 (5G). This, in turn, led to the systematization of stages of technology development according to the following criteria:
• 1G – the emergence of analog communication;
• 2G – digital transformation, namely switching channels in both radio access and backbone networks;
• 2.5G, 2.75G – packet switching in radio access; switching channels in the backbone network;
• 3G – a revolutionary change that ensures the compatibility of generations;
• 4G – a packet network that contains a set of generations (switching in both radio and backbone).
Every technology is ordinary; at its development stage, at first it differed in speed, volume, radio frequency channel, and technology. But the development of 5G technology is a work at a higher wave frequency: the more frequencies there are, the more opportunities we have to deliver the signal, the greater the network coverage is. That is, the higher the frequency is, the more we can transmit information over the same time.
Thus, 5G gives the world several technical advantages, such as a peak data rate of 20 Gbps, i.e. almost 20 times more than 4G LTE; at least 1 million connected devices per square kilometer located near the station or tower; mobility of movement almost to 500 km/h, while 4G – 120 km/h; the ability to save energy through the function of the so-called "sleep mode" of the station; spectral efficiency; and a minimum delay of up to 1 m/s. Such innovations can only be used in the future, and they must be justified in terms of revolutionary change, as Europe is projected to spend more than € 150 billion on the 5G project only due to a huge potential of digital economy:
•In the field of energy and utilities, the availability of fast and reliable 5G communication will allow continuous monitoring of systems with sensors, which will reduce the need for human intervention and increase the security of power systems. 5G will also allow remote monitoring of energy facilities and solar farms.
•Introduction of the so-called Internet of Things. The European Commission estimated that by 2020, about 200 million smart electricity meters and 45 million "smart" gas meters would have been produced. Simultaneously, it is estimated that approximately 72% of consumers in Europe will have smart electricity meters and 40% - smart gasometers, which will allow using energy more efficiently.
•Introduction of a smart home system;
•Sensors that are used to report crimes and, for example, traffic.
•Low data transmission delay will provide an instant exchange of information between remotely piloted vehicles;
•In health care, digitalization will help more people seek help and improve their living standards, online fitness trackers that monitor health, robotic surgery.
•Intelligent farming, which collected data on the availability of resources on the planet and its quantity, will be able to monitor the level of humidity, soil condition and plant life indicators online;
In parallel with the establishment of a supranational regulatory body in the field of telecommunications in the EU, Directive 2002/21 / EU of the European Parliament and of the Council of 7 March 2002 (Framework Directive) introduced a harmonized legal framework for regulating electronic communications services, electronic communications networks and equipment as well as implemented the procedures to ensure the harmonized application of legal mechanisms within the EU. This meant that countries had to implement national telecoms regulators' creation in their legal framework under the Acquis communautaire. This is how regulators appeared in every EU member state.
The EU's role as a regulatory body can be only considered comprehensive in tandem with each Member State's NRA. Europe is the home to telecommunications giants such as Sweden's Ericsson and TeliaSonera, France's Alcatel-Lucent and Orange, Britain's Vodafone and Liberty Global, Italy's Telefonica and Telecom Italia, Norway's Telenor and Germany's Deutsche Telecom. Sometimes, the national regulators' level is insufficiently qualified or may not have enough influence to address the issues mainly related to competition, even at the geopolitical level. The main initiative for creating the ECR and introduction of the 5G generation was expressed in the adoption on November 14, 2018, of the EEC Code and the establishment of BEREC. The main emphasis on the regulation of telecommunications networks in the context of 5G implementation is made on the equal access of market players, joint investment in new high-speed networks and risk-sharing in the construction of new networks, stable competition through new rules of symmetric regulation and close supervision by EC and BEREC to ensure and strengthen the internal market. Another important component is the protection of end-users. And given the huge investment in next-generation communications, and the growth of Huawei and China as a technological superpower by creating a single high-quality and relatively inexpensive equipment to implement 5G on certain radio frequencies, the activities of NRAs, BEREC, the EC, and European Commissioners are important in order not to lose the European geopolitical influence and the modern economy's continuous development, even in the COVID-19 pandemic.
Thus, national regulatory authorities and other competent state bodies will remain responsible for applying the rules established by the EEC Code in each EU member state and be carried out under the supervision of BEREC and the EC.
DE : Die Aktualität der Forschung liegt darin, dass informations- und Telekommunikationstechnologien in der modernen Welt sind ein wichtiger Motor für den wirtschaftlichen Fortschritt und die Modernisierung nahezu aller Lebensbereiche. Heute befindet sich die Welt im Übergang von einer Industrie- zu einer Informationsgesellschaft. Dies ist natürlich auf die raschen Veränderungen und Revolutionen im Bereich der Informationstechnologie und Telekommunikation zurückzuführen, und zwar im Zusammenhang mit der Einführung der Kommunikation der fünften Generation. Diese Veränderungen wirken sich nicht nur auf die technologische Komponente aus, sondern auch direkt auf das Leben. Neue Telekommunikationsnetze verbessern den Zugang der Bevölkerung zu Informationen, geben den Menschen die Möglichkeit, in extrem kurzer Zeit die richtige Antwort auf jede Frage zu finden, beziehen normale Menschen in den Prozess ein, wichtige Entscheidungen auf staatlicher Ebene zu treffen, und schaffen neue Arbeitsplätze. Neue Technologien ebnen auch den Weg für eine neue, unerforschte Zukunft: Hochgeschwindigkeits-Transportsysteme, Smart Homes, das Internet der Dinge und mehr. Aus diesem Grund ist der Aufbau einer neuen offenen Informationsgesellschaft ohne die Einführung einer neuen Generation von Kommunikation unmöglich, die es ermöglichen würde, dieses Potenzial im Rahmen der europäischen Gesetzgebung maximal und ohne perfekte rechtliche Regulierung auszuschöpfen. Heute kann ein großes IT-Unternehmen ein tausendstes Werk in Bezug auf die Rentabilität ersetzen. Und "digitale Diplomatie" ist bereits ein wichtiges Markeninstrument und ein Mittel zur Entwicklung von Verhandlungen zwischen Staaten. Die Einführung der Kommunikation der 5. Generation hat sowohl positive als auch negative Seiten. Viele Utopisten und Wissenschaftler glauben, dass eine umfassende Digitalisierung zu einer vollständigen Kontrolle aller Lebensbereiche im Internet führen wird, andererseits zu einer Verringerung von Kriminalität, Mord und Kriminalität im Allgemeinen. Bereits heute haben große Unternehmen in Europa Frequenzauktionen zur Einführung der Kommunikation der fünften Generation gewonnen und Hunderte Milliarden Euro ausgegeben, um dieses Ziel zu erreichen. Aus diesem Grund muss sich die Europäische Union als wichtiger internationaler Schiedsrichter eine moderne Politik zur Einführung eines neuen starken Motors entwickeln und den Zugang zu dieser unabhängigen Struktur regeln, um die Monopolisierung der Eliten zu verhindern.
Die moderne Außenpolitik der Ukraine ist in allen Bereichen eng mit der europäischen Integration verbunden, auch im Kontext der Informations- und Kommunikationstechnologien. Die Ukraine ist heute eines der führenden Länder, das die besten IT-Fachkräfte anbietet und für Projekte im Bereich Informations- und Kommunikationssysteme gefragt ist. Ukrainische Spezialisten beteiligen sich bereits an der Implementierung der führenden Produkte der Zukunft, wie dem Zustand im Smartphone, transparent usw. Und unsere Spezialisten arbeiten in den weltweit führenden Unternehmen: YouTube, Facebook, Google, Twitter, implementieren ihre eigenen Projekte und helfen, alle Lebensbereiche zu digitalisieren und jeden Prozess zu automatisieren, sowohl in der Industrie als auch in der IT und in unserem täglichen Leben. Aufgrund des Fehlens eines perfekten Rechtsrahmens kann die Ukraine ihr IT-Potenzial jedoch nicht voll ausschöpfen. Gemäß dem Gesetz der Ukraine "Über das nationale Programm zur Anpassung der ukrainischen Gesetzgebung an die Gesetzgebung der Europäischen Union" ist es für uns eine wichtige strategische Aufgabe, die nationale Gesetzgebung vollständig anzupassen. Europäische Union für die Umsetzung der Innen- und Außenpolitik.
Das Forschungsobjekt ist die EU-Regulierungspolitik im Bereich der Telekommunikation.
Der Gegenstand dieser Forschungsarbeit sind EU-Richtlinien im Zusammenhang mit der Einführung der Kommunikation der 5. Generation.
Das Ziel der Forschung ist es, die gesetzlichen Bestimmungen der EU im Bereich der raschen Entwicklung der Telekommunikation zu untersuchen.
Um die oben genannten Ziele zu erreichen, müssen wir die folgenden spezifischen Forschungsziele untersuchen:
1) Untersuchung der methodischen Prinzipien des Forschungsthemas;
2) Analyse der EU-Regulierungspolitik im Bereich Telekommunikation;
3) Die Geschichte der Telekommunikation im europäischen Raum;
4) Die Systematisierung der Kenntnis des EU-Rechtsrahmens im Bereich Telekommunikation;
5) Die Untersuchung der Richtlinien als Mittel der EU-Regulierungspolitik im Bereich der Umsetzung der Kommunikation der fünften Generation.
Schlussfolgerungen. Die moderne Welt befindet sich wirklich im Übergang von einer Industriegesellschaft zu einer Informationsgesellschaft. Die Hauptantriebskraft in dieser Phase ist natürlich der Wandel in der Telekommunikation und Kommunikation, da diese Prozesse des Sendens, Empfangens und Verarbeitens von Informationen über verschiedene Entfernungen unter Verwendung der Netzwerktechnologie der Motor der Revolution sind.
Von den 1950er bis 1990er Jahren wurden sich verschiedene Technologien im Bereich der Telekommunikation entwickelt und entwickelt, von Satelliten- und fortschrittlichen Kabelsystemen bis hin zu Digital- und Glasfasertechnologie und Videokommunikation. Die Kommunikationsbranche wurde in den letzten Jahrzehnten vollständig computerisiert. All diese Änderungen haben zur weltweiten Verbreitung von Telekommunikationssystemen beigetragen, auch in Europa.
Zu dieser Zeit nahm der geopolitische Akteur, die Europäische Union, Gestalt an. Die Gründung der EU wurde mit der Unterzeichnung des Vertrags von Maastricht im Jahr 1992 abgeschlossen. Daher musste sich die Europäische Union als supranationales Gremium einen guten rechtlichen und regulatorischen Rahmen entwickeln, um die Entwicklung von Telekommunikations- und Kommunikationstechnologien nicht zu behindern, und gleichzeitig als Schiedsrichter bei Marktkonflikten und gleicher Verteilung staatlicher Funkfrequenzen und Strategieziele fungieren.
Die Geschichte der Gründung der EU und der Umgestaltung ihrer institutionellen Struktur ist mehr als ein Jahrzehnt alt. Natürlich blieben die wichtigsten Leitungsgremien dieselben: die Europäische Kommission, das Europäische Parlament, der Rat der EU und der Europäische Gerichtshof. Die Bildung neuer Regulierungsbehörden in engen Wirtschaftsbereichen ist jedoch ein Beispiel für Fachwissen und ein Beispiel für die Nachahmung des europäischen Rechts, wie ein Rechtsrahmen für eine erfolgreiche staatliche Regulierung verschiedener Wirtschaftssektoren entwickelt werden kann. Das Hauptziel der Union - auch unverändert - ist es, Integrationshindernisse zu überwinden, die richtigen Lösungen zu finden und umzusetzen. Im Bereich der Telekommunikation und der Kommunikation strebt die EU die Schaffung eines einheitlichen digitalen Raums an, der von den NRB und dem GEREK reguliert wird.
Die Geschichte der Telekommunikationsintegration der EU-Länder ist die Verkörperung von Entwicklungsprogrammen und -konzepten zur Beseitigung von Hindernissen und Ungleichheiten zwischen Ländern und geht auf die oben erwähnten Verhandlungen in Maastricht zurück. Es war dieser Vertrag, der den Acquis communautaire (aus dem Französischen - "Gemeinschaftseigentum") bildete und erklärte, ein Rechtsbegriff im System der Rechtsnormen der Europäischen Union. Dies bedeutet, dass die verschiedenen in der EU verabschiedeten Grundsätze, Regeln und Normen der obligatorischen Bewahrung, der Entwicklung und der Umsetzung in den Rechtsvorschriften der Mitgliedstaaten unterliegen.
Daher strebte die EU zwischen 2000 und 2010 Jahren die Schaffung einer neuen Regierung im Wesentlichen elektronischer Technologie und einer neuen intellektuellen Gesellschaft an, die das Potenzial neuer und führender Telekommunikationsnetze nutzen würde. Zu diesem Zweck musste die Europäische Kommission die Umsetzung der Rechtsvorschriften im Bereich der Elektronik und der Telekommunikation sicherstellen. Eine besondere Rolle beim Aufbau eines erfolgreichen Rechtsrahmens spielten die Borozzo-Kommission und separat Vivian Reding, Kommissarin für die Informationsgesellschaft. Sie war eine der ersten Spezialisten, die sich in dieser neu geschaffenen Position befand und versuchte, ein Gesetzespaket zu initiieren, das das Urheberrecht regelt und die sogenannte "Piraterie", die jährlich etwa 20 Millionen Euro kostet, über das Internet stoppt. Das Telekommunikationspaket deckt eine breite Palette von Themen ab, von der Verbreitung von Informationen aus Radio- und Fernsehkanälen bis zur Schaffung einer europaweiten Regulierungsbehörde, die die Vertraulichkeit von Benutzerinformationen schützt. Im weitesten Sinne soll das Gesetz die Bildung eines Telekommunikationsbinnenmarktes für die EU sicherstellen. Die Hauptaufgabe des EU-Kommissars für digitale Wirtschaft und Gesellschaft besteht neben der Überwachung und der Umsetzung von Maßnahmen im Einflussbereich auch darin, Gesetzesinitiativen und Vorschläge zur Schaffung eines gemeinsamen Telekommunikationsmarktes zu fördern. Im Bereich der Telekommunikation und der Kommunikation spielten daher zunächst der EU-Kommissar und die Generaldirektion für Kommunikationsnetze, Inhalte und Technologie, für die der EU-Kommissar für digitale Wirtschaft und Gesellschaft zuständig ist, eine wichtige Rolle. Ihre Zuständigkeit bestand darin, sich die Richtlinien zu entwickeln und die Umsetzung der vom Rat und vom Europäischen Parlament getroffenen Entscheidungen zu überwachen. Sie waren in der Tat die Organe der Regulierungspolitik.
Wenn wir den Buchstaben "G" sehen, bedeutet dies "Generation", die auf der Basis von der Technologie wie der ersten Generation aufgebaut ist. In den 1980er Jahren dachte niemand über Datendienste nach und benutzte das Telefon nur für Sprachanrufe und einige andere unentwickelte Funktionen. Später tauchten jedoch Technologien auf, wie z. B.: GSM - das erste globale Mobilkommunikationssystem, General Packet Radio Service (GPRS), UMTS (Universal Mobile Telecommunications System), CDMA2000, EDGE (Enhanced Data-Rates for) GSM Evolution), IMT-Advanced (International Mobile Telecommunications-Advanced) und IMT-2020 (5G).
Jede Technologie ist gewöhnlich und unterschied sich im Stadium ihrer Entwicklung zunächst in der Geschwindigkeit, der Lautstärke, Hochfrequenzkanal und der Technologie. Die Entwicklung der 5G-Technologie ist jedoch eine Arbeit mit einer höheren Wellenfrequenz: Je mehr ist Frequenzen - desto mehr sind die Möglichkeiten zur Signalübertragung und desto größer sind die Netzabdeckung. Das heißt, je höher die Frequenz ist, desto mehr Informationen können wir gleichzeitig übertragen.
Somit bietet 5G der Welt eine Reihe technischer Vorteile, wie beispielsweise eine maximale Datenrate von 20 Gbit / s, d.h. fast 20-mal mehr als 4G LTE; mindestens 1 Million angeschlossene Geräte pro Quadratkilometer in der Nähe der Station oder des Turms; die Bewegungsbeweglichkeit fast bis 500 km / h, während 4G - 120 km / h; die Fähigkeit, die Energie durch die Funktion des sogenannten "Schlafmodus" der Station zu sparen; Spektrale Effizienz. Solche Innovationen können in der Regel nur in der Zukunft eingesetzt werden und müssen im Hinblick auf den revolutionären Wandel gerechtfertigt sein, da Europa voraussichtlich mehr als 150 Milliarden Euro für das 5G-Projekt ausgeben wird. Und das alles wegen des enormen Potenzials der digitalen Wirtschaft.
Parallel zur Einrichtung einer supranationalen Regulierungsbehörde im Bereich der Telekommunikation in der EU wurde mit der Richtlinie 2002/21 / EU des Europäischen Parlaments und des Rates vom 7. März 2002 (Rahmenrichtlinie) ein harmonisierter Rechtsrahmen für die Regulierung elektronischer Kommunikationsdienste, elektronischer Kommunikationsnetze und -ausrüstung eingeführt.
Die Rolle der EU als Regulierungsbehörde kann nur zusammen mit der NRB jedes Mitgliedstaats als umfassend angesehen werden. In Europa sind Telekommunikationsgiganten wie Ericsson und TeliaSonera aus Schweden, Alcatel-Lucent und Orange aus Frankreich, Vodafone und Liberty Global aus Großbritannien, Telefonica und Telecom Italia aus Italien, Telenor aus Norwegen und Deutsche Telecom aus Deutschland ansässig. Manchmal ist das Niveau der nationalen Regulierungsbehörden nicht ausreichend qualifiziert oder hat möglicherweise nicht genügend Einfluss, um Probleme anzugehen, die hauptsächlich mit Wettbewerbsfragen zusammenhängen, selbst auf geopolitischer Ebene. Die Hauptinitiative für die Schaffung des ECR und die Einführung der 5G-Generation kommt in der Annahme des EWG-Kodex und der Einrichtung des GEREK am 14. November 2018 zum Ausdruck. Das Hauptaugenmerk auf die Regulierung von Telekommunikationsnetzen im Rahmen der 5G-Implementierung liegt auf dem gleichberechtigten Zugang der Marktteilnehmer, gemeinsamen Investitionen in neue Hochgeschwindigkeitsnetze und der Risikoteilung beim Aufbau neuer Netze, einem stabilen Wettbewerb durch neue Regeln der symmetrischen Regulierung und einer sorgfältigen Überwachung durch EG und GEREK, um dies sicherzustellen. Eine weitere wichtige Komponente ist der Schutz der Endbenutzer. Angesichts der enormen Investitionen in die Kommunikation der nächsten Generation und des Wachstums von Huawei und China als technologische Supermacht durch die Schaffung eines einzigen hochwertigen und relativ kostengünstigen Geräts zur Implementierung von 5G auf bestimmten Funkfrequenzen sind die Aktivitäten von NRB, GEREK, EG und EU-Kommissaren wichtig, um den geopolitischen Einfluss Europas und die kontinuierliche Entwicklung der modernen Wirtschaft auch bei einer Pandemie durch COVID-19 nicht zu verlieren.
Somit bleiben die nationalen Regulierungsbehörden und andere zuständige staatliche Stellen für die Anwendung der im EWG-Kodex festgelegten Regeln in jedem EU-Mitgliedstaat verantwortlich und werden unter der Aufsicht des GEREK und der EG durchgeführt.
