UA : Мета дослідження: визначити перешкоди для розвитку місцевого
референдуму в Україні та охарактеризувати шляхи його вдосконалення як прямої
форми вирішення проблем місцевого значення територіальною громадою.
Об’єкт дослідження: форма безпосередньої демократії на рівні
територіальних громад.
Предмет дослідження: місцевий референдум як фактор розвитку
територіальних громад.
Методи дослідження: аналіз, синтез, індукція, дедукція, структурно-
функціональний, аналіз статистичних даних.
Новизна дослідження: в даній роботі пропонується врегулювання
нормативно-правової бази для забезпечення проведення місцевих референдумів,
як чиннику продовження подальшого поступального розвитку територіальних
громад та перетворення їх з об’єкта прийняття рішень на активного суб’єкта
місцевого управління.
Гіпотеза: місцевий референдум є ефективною альтернативою існуючим
формам впливу територіальної громади на вирішення питань місцевого значення.
Висновки: 1. Існуючі форми народовладдя хоч і є достатньо
диференційованими, проте не здатні забезпечити прийняття безпосередньо
місцевою громадою загальнообов’язкових рішень.
2. Аналіз використання в Україні інституту місцевого референдуму за період
з 1991 по 2012 рік підтвердив його ефективність та спроможність безпосереднього
залучення жителів місцевих громад до вирішення локальних питань.
3. Прийняття закону «Про місцевий референдум» відновить реальну
можливість членів територіальних громад брати участь у вирішення значної
кількості питань місцевого значення шляхом прямого волевиявлення.
EN : The purpose of research: to identify the obstacles to the development of local
referendums in Ukraine and characterize the ways of its improvement as a direct form
of solving issues of local importance by the territorial community.
Object of research: a form of direct democracy at the level of territorial
communities.
Subject of research: local referendum as a factor of territorial community
development.
Research methods: analysis, synthesis, induction, deduction, structural and
functional, statistical data analysis.
The novelty of research: this work proposes the legal framework regulation to
ensure realization of local referendums as a factor for further progressive development
of territorial communities and their transformation from an object of decision-making
to an active subject of local government.
Hypothesis: a local referendum is an effective alternative to existing forms of
territorial community influence on solving issues of local importance.
Conclusions: 1. Although the existing forms of democracy are differentiated
enough, they are not able to ensure the acceptance of generally mandatory decisions
by the local community.
2. The analysis of the use of the local referendum institution in Ukraine for the
period from 1991 to 2012 confirmed its effectiveness and ability to directly involve
residents of local communities in solving issues of local importance.
3. The approval of the Law “On Local Referendum” will restore the real
opportunity for territorial community members to participate in resolving a significant
number of issues of local importance through direct expression of will.
