Конституційно-правова відповідальність посадових осіб місцевого самоврядування

Abstract

UA : У роботі досліджено теоретико-правові та практичні аспекти законодавчого регулювання конституційно-правової відповідальності посадових осіб місцевого самоврядування. Доведено, що чинні нормативно-правові акти містять фрагментарність та їх законодавче забезпечення є недосконалим. Сформовано та розкрито особливості конституційно-правової відповідальності посадових осіб місцевого самоврядування в Україні. Проаналізовано поняття та досліджено співвідношення конституційно-правової та муніципально-правової і політичної відповідальності посадових осіб місцевого самоврядування, а також розкрито підстави, умови та порядок притягнення до конституційно-правової відповідальності посадових осіб місцевого самоврядування. Проведено аналіз форм та видів конституційно-правової відповідальності посадових осіб місцевого самоврядування та окреслено її зміст.EN : The work examines the theoretical, legal and practical aspects of legislative regulation of the constitutional and legal liability of local government officials. It is proven that the current regulatory legal acts contain fragmentation and their legislative support is imperfect. The features of the constitutional and legal liability of local government officials in Ukraine are formed and revealed. The concept is analyzed and the correlation of constitutional and legal and municipal and political liability of local government officials is investigated, and the grounds, conditions and procedure for holding local government officials to constitutional and legal liability are also revealed. An analysis of the forms and types of constitutional and legal liability of local government officials was conducted and its content was outlined. Based on the results of the master's research, proposals and recommendations were developed for improving the current legislation regulating the constitutional and legal liability of local government bodies and officials, based on positive foreign experience.
