UA : Кваліфікаційна робота магістра складається з 90 сторінок друкованого тексту, містить 14 джерел та 20 позицій літератури.

Сучасна система міжнародних відносин перебуває у стані глибокої трансформації та кризи, яка кидає виклик усталеній архітектурі глобальної безпеки. Механізми мирного врегулювання конфліктів, закладені в Статуті ООН після Другої світової війни, дедалі частіше демонструють свою неефективність перед обличчям нових загроз. У цьому складному контексті інститут міжнародних санкцій ООН залишається одним із небагатьох легітимних інструментів примусу, що знаходиться в розпорядженні світової спільноти, займаючи проміжне місце між дипломатичним осудом та застосуванням військової сили. Актуальність дослідження цієї проблематики зумовлена тим, що санкційна політика пройшла складну еволюцію від комплексних ембарго 1990-х років, які мали тяжкі гуманітарні наслідки, до сучасних «розумних» санкцій. Особливого значення це набуває в умовах, коли система прийняття рішень у Раді Безпеки ООН часто виявляється паралізованою через застосування права вето постійними членами.
Об’єктом дослідження у роботі виступає система колективної безпеки Організації Об’єднаних Націй та міжнародно-правові механізми невійськового примусу, а предметом – еволюція, інституційно-правові засади та ефективність застосування міжнародних санкцій ООН як інструменту політичного впливу. Метою роботи є здійснення всебічного аналізу інституту санкцій, виявлення проблем їх імплементації та оцінка ефективності на основі порівняльного аналізу конкретних кейсів.
У теоретико-правовому блоці дослідження встановлено, що Статут ООН свідомо уникає терміна «санкції», використовуючи натомість більш нейтральні формулювання про «заходи, не пов’язані з використанням збройних сил» (стаття 41). Це вказує на те, що санкційний механізм розглядається не як каральний інструмент у кримінально-правовому розумінні, а як специфічний засіб відновлення міжнародного правопорядку та припинення загроз миру.
Легітимність таких заходів базується на добровільній згоді держав, вираженій у ратифікації Статуту, якою вони делегували Раді Безпеки виключні повноваження діяти від імені всього співтовариства. Важливо розрізняти санкції ООН від реторсій та контрзаходів, оскільки останні є децентралізованими діями окремих держав, тоді як заходи РБ ООН є централізованими та юридично обов’язковими для виконання всіма членами Організації.
Історичний аналіз дозволив виокремити фундаментальну трансформацію санкційних режимів. Період після закінчення Холодної війни, відомий як «санкційне десятиліття», характеризувався активним використанням комплексних торговельних та економічних ембарго проти таких країн як Ірак, Югославія та Гаїті. Проте досвід санкцій проти Іраку (1990-2003 рр.) став переломним моментом. Тотальна ізоляція економіки завдала катастрофічної шкоди цивільному населенню, спричинивши гуманітарну кризу, але не призвела до падіння авторитарного режиму, який лише зміцнив контроль над розподілом дефіцитних ресурсів. Криза легітимності змусила міжнародну спільноту шукати альтернативи, що призвело до появи концепції «розумних» (таргетованих) санкцій. Нова парадигма, розроблена в рамках Інтерлакенського та Боннсько-Берлінського процесів, базується на принципі «хірургічної точності»: тиск має бути спрямований безпосередньо на еліти, відповідальні за прийняття рішень, мінімізуючи побічну шкоду для населення. Основними інструментами стали персональні фінансові санкції, заборони на поїздки, збройові ембарго та секторальні обмеження.
Аналіз інституційного механізму виявив, що центральну роль у санкційній політиці відіграє Рада Безпеки, яка володіє дискреційними повноваженнями визначати наявність «загрози миру» та обирати заходи впливу. Однак ефективність цього органу суттєво обмежена правом вето п’яти постійних членів, що перетворює процес прийняття рішень на заручника геополітичного протистояння. Це призводить до вибірковості застосування санкцій: Рада жорстко реагує на загрози з боку країн, що не мають потужних покровителів, але залишається бездіяльною у конфліктах, де задіяні інтереси великих держав. Адміністрування санкцій покладається на допоміжні органи - Санкційні комітети та Групи експертів. Хоча Групи експертів виконують важливу функцію моніторингу та розслідування порушень, їхня робота часто наштовхується на політичний опір у Санкційних комітетах, які працюють на основі консенсусу, що дозволяє блокувати важливі рішення без публічних пояснень.
Найслабшою ланкою системи є етап національної імплементації. Оскільки ООН не має власних органів примусу, реальне виконання санкцій залежить від політичної волі та адміністративної спроможності держав-членів. Дослідження виявило значний «імплементаційний розрив», зумовлений відсутністю гармонізованого законодавства, корупцією та складністю контролю товарів подвійного використання. Водночас важливу роль «силових мультиплікаторів» відіграють регіональні організації, зокрема Європейський Союз, та спеціалізовані установи, такі як FATF, стандарти якої зробили виконання фінансових санкцій ООН обов’язковим для глобальної банківської системи.
Оцінка ефективності санкцій у роботі здійснена за допомогою тривимірної методологічної моделі, що включає функції примусу, обмеження та сигналізування. Аналіз кейсу КНДР (2006–2023) показав, що у вимірі примусу санкції зазнали невдачі: мета денуклеаризації не була досягнута, оскільки режим розглядає ядерну зброю як гарантію виживання. Проте у функції обмеження санкції виявилися частково ефективними, суттєво підвищивши вартість ракетної програми та сповільнивши її розвиток. Натомість кейс Ірану (2006-2015 рр.) продемонстрував успішність функції примусу. Поєднання легітимних резолюцій ООН із жорсткими вторинними санкціями США та нафтовим ембарго ЄС створило нестерпний економічний тиск, який разом із наявністю внутрішньої політичної конкуренції та реалістичною дипломатичною пропозицією призвів до підписання Ядерної угоди (СВПД). Кейс Лівії (2011) став прикладом швидкого реагування на гуманітарну кризу через миттєве замороження активів, що позбавило режим ресурсів для найманців, але подальший розпад державності створив нові виклики для управління цими активами.
Дослідження також виявило серйозні негативні наслідки санкційної політики. Феномен «надмірного дотримання» з боку глобальних банків призводить до фактичної блокади легальних гуманітарних транзакцій, що порушує права цивільного населення. Крім того, існує правова колізія між імперативним характером резолюцій РБ ООН та стандартами захисту прав людини, зокрема правом на справедливий суд для осіб, внесених до санкційних списків. Створення Офісу Омбудсмена для окремих режимів стало кроком уперед, але не вирішило проблему системно.
У підсумку роботи зроблено висновок, що попри численні вади, вибірковість та обмежену результативність, міжнародні санкції ООН залишаються безальтернативним інструментом підтримання глобального порядку в ситуаціях, коли дипломатія вичерпана, а війна є неприйнятною. Майбутнє цього інструменту залежить від здатності ООН до реформування, зокрема в напрямку демократизації процесу прийняття рішень, обмеження права вето у випадках масових звірств, створення незалежних механізмів оцінки наслідків та адаптації до нових технологічних викликів.

The modern system of international relations is in a state of deep transformation and crisis, challenging the established architecture of global security. Mechanisms for the peaceful settlement of conflicts, enshrined in the UN Charter after the Second World War, are increasingly demonstrating their inefficiency in the face of new threats. In this complex context, the institution of international UN sanctions remains one of the few legitimate instruments of coercion available to the international community, occupying an intermediate position between diplomatic condemnation and the use of military force. The relevance of researching this issue is driven by the fact that sanctions policy has undergone a complex evolution from the comprehensive embargoes of the 1990s, which had severe humanitarian consequences, to modern «smart» sanctions. This acquires particular significance in conditions where the decision-making system in the UN Security Council often finds itself paralyzed due to the use of the veto power by permanent members. The object of the research in the thesis is the collective security system of the United Nations and international legal mechanisms of non-military coercion, while the subject is the evolution, institutional-legal foundations, and effectiveness of the application of international UN sanctions as a tool of political influence. The aim of the work is to conduct a comprehensive analysis of the sanctions institute, identify implementation problems, and assess effectiveness based on a comparative analysis of specific cases. In the theoretical-legal block of the study, it was established that the UN Charter deliberately avoids the term «sanctions», using instead more neutral formulations about «measures not involving the use of armed force» (article 41). This indicates that the sanctions mechanism is viewed not as a punitive instrument in the criminal-legal sense, but as a specific means of restoring international legal order and halting threats to peace. The legitimacy of such measures is based on the voluntary consent of states, expressed in the ratification of the Charter, by which they delegated exclusive powers to the Security Council to act on behalf of the entire community. It is important to distinguish UN sanctions from retorsions and countermeasures, as the latter are decentralized actions of individual states, whereas UN Security Council measures are centralized and legally binding for all Organization members. Historical analysis allowed for the identification of a fundamental transformation of sanctions regimes. The period following the end of the Cold War, known as the «Sanctions Decade», was characterized by the active use of comprehensive trade and economic embargoes against countries such as Iraq, Yugoslavia, and Haiti. However, the experience of sanctions against Iraq (1990-2003) became a turning point. Total economic isolation inflicted catastrophic damage on the civilian population, causing a humanitarian crisis, but did not lead to the fall of the authoritarian regime, which only strengthened its control over the distribution of scarce resources. The legitimacy crisis forced the international community to seek alternatives, leading to the emergence of the concept of «smart» sanctions. The new paradigm, developed within the framework of the Interlaken and Bonn-Berlin processes, is based on the principle of «surgical precision»: pressure should be directed specifically at the elites responsible for decision-making, minimizing collateral damage to the population. The main instruments became personal financial sanctions, travel bans, arms embargoes, and sectoral restrictions. The analysis of the institutional mechanism revealed that the central role in sanctions policy is played by the Security Council, which possesses discretionary powers to determine the existence of a «threat to the peace» and choose measures of influence. However, the effectiveness of this body is significantly limited by the veto power of the five permanent members, turning the decision-making process into a hostage of geopolitical confrontation. This leads to selectivity in the application of sanctions: the Council reacts harshly to threats from countries without powerful patrons but remains inactive in conflicts where the interests of major powers are involved. The administration of sanctions is entrusted to subsidiary bodies - Sanctions Committees and Panels of Experts. Although Panels of Experts perform the important function of monitoring and investigating violations, their work often encounters political resistance in Sanctions Committees, which operate on the basis of consensus, allowing important decisions to be blocked without public explanation. The weakest link in the system is the stage of national implementation. Since the UN lacks its own enforcement bodies, the actual execution of sanctions depends on the political will and administrative capacity of member states. The study revealed a significant «implementation gap» caused by the lack of harmonized legislation, corruption, and the complexity of controlling dual-use goods. At the same time, an important role as «force multipliers» is played by regional organizations, particularly the European Union, and specialized agencies such as the FATF, whose standards have made compliance with UN financial sanctions mandatory for the global banking system. The assessment of sanctions effectiveness in the work was carried out using a three-dimensional methodological model that includes the functions of coercion, constraint, and signaling. The analysis of the DPRK case (2006-2023) showed that in the dimension of coercion, sanctions failed: the goal of denuclearization was not achieved, as the regime views nuclear weapons as a guarantee of survival. However, in the function of constraint, sanctions proved partially effective, significantly increasing the cost of the missile program and slowing its development. In contrast, the Iran case (2006-2015) demonstrated the success of the coercion function. The combination of legitimate UN resolutions with tough secondary sanctions from the US and the EU oil embargo created unbearable economic pressure, which, together with the existence of internal political competition and a realistic diplomatic proposal, led to the signing of the Nuclear Deal (JCPOA). The Libya case (2011) became an example of rapid reaction to a humanitarian crisis through an immediate asset freeze, which deprived the regime of resources for mercenaries, but the subsequent collapse of statehood created new challenges for managing these assets. The study also identified serious negative consequences of sanctions policy. The phenomenon of «over-compliance» by global banks leads to a de facto blockade of legal humanitarian transactions, violating the rights of the civilian population. Furthermore, there is a legal conflict between the imperative nature of UN Security Council resolutions and human rights standards, particularly the right to a fair trial for individuals placed on sanctions lists. The creation of the Office of the Ombudsperson for specific regimes was a step forward but did not solve the problem systemically. In conclusion, the work states that despite numerous flaws, selectivity, and limited effectiveness, international UN sanctions remain an alternative-free instrument for maintaining global order in situations where diplomacy is exhausted and war is unacceptable. The future of this instrument depends on the UN's ability to reform, particularly towards democratizing the decision-making process, limiting the veto power in cases of mass atrocities, creating independent mechanisms for assessing consequences, and adapting to new technological challenges.
