Англомовна юридична термінологія та специфіка її перекладу

Abstract

UA : Об’єктом дослідження виступає англомовна юридична термінологія. Предметом праці є семантико-морфологічні аспекти англомовної юридичної термінології та прийоми й стратегії її перекладу. Мета роботи: визначення семантичних, морфологічних та структурних особливостей англомовної юридичної термінології та специфіки її перекладу на українську мову. Методологічною базою дослідження стали теоретичні ідеї та концепції стосовно проблеми визначення терміна, особливостей терміносистем та способів та прийомів перекладу юридичної термінології, розроблені такими вченими як Т. І. Панько, З. Б. Куделько, В. Д. Бялика, Ю. О. Семенчука, В. В. Коптілова, С. М. Єнікєєвої, Р. І. Дудока. Отримані результати: З погляду морфологічної будови терміни

англомовної юридичної сфери поділяються на прості, складні (та терміни- словосполучення. Найбільш продуктивними способами словотворення

субстантивної юридичної термінології в англійській мові є афіксація. За структурним критерієм складні терміни діляться на ті, які утворені шляхом основоскладання та пишуться разом, через дефіс (due-process) а також ті, терміни, які мають структуру словосполучення. Вони у свою чергу діляться на іменникові, прикметникові та дієслівні словосполучення відповідно до головного слова. До основних прекладацьких стратегій належать розмежування полісемантичних лексичних одиниць, диференціація омонімів, прагматичний аналіз вихідного тексту, дотримання синтаксичної та семантичної структури, досягнення зв’язності і узгодженості тексту перекладу.

EN : The work is devoted to highlighting the peculiarities of English-language legal terminology and ways of its translation. The object of research is English-language legal terminology.

The subject of the work is the semantic-morphological aspects of English- language legal terminology and the techniques and strategies of its translation.

The purpose of the work: to determine the semantic, morphological and structural features of English-language legal terminology and the specifics of its translation into Ukrainian. Following the purpose of the study, it is necessary to carry out the following main objectives: - to establish morphological features of English-language legal terminology; - to determine the syntactic features of complex legal terms; - to characterize the main methods of its translation into Ukrainian; - to identify translation strategies aimed at overcoming the difficulties of translating English-language legal terms. The scientific novelty of the work consists in a comprehensive study of semantic, morphological and syntactic features of English-language legal terminology and methods and strategies for overcoming difficulties in its translation into Ukrainian.

From the point of view of morphological structure, the terms of the English- speaking legal sphere are divided into simple, complex and word-combination

terms. The most productive way of word formation of legal nouns in the English language is affixation. Strategies that help to achieve the adequacy of the translated text and avoid ambiguity are the delimitation of polysemantic lexical units, the pragmatic analysis of the source text, compliance with the syntactic and semantic structure, and the achievement of coherence and coherence of the translated text.
