Запровадження основних принципів захисту прав і свобод людини при реформуванні судової системи України

Abstract

Обʼєктом дослідження є суспільні відносини, що складаються у процесі реформування судової системи України щодо захисту прав і свобод людини. Предметом дослідження є судова система, основною функцією якої виступає захист прав і свобод людини, а також практична реалізація даної функції та її нормативно-правове забезпечення, роль при реформуванні судової системи України. Після Революції Гідності, повалення попереднього політичного режиму у 2014 році, держава Україна взяла впевнений курс розвитку основних соціально-економічних сфер життя українського суспільства в напрямку Європейського союзу. Останні п’ять років у країні було здійснено багато перетворень, зокрема і у судовій гілці влади. У той же час, оскільки згідно положень національного законодавства, на захисті прав і свобод українців стоїть саме інститут суду, розглядтеми запровадження принципів захисту у судову систему є надзвичайно важливим та актуальним. Увесь європейський правовий вимір побудований навколо захисту прав і свобод людини, а отже і Україна, у прагненні стати членом Союзу, повинна дотримуватися визначених європейських стандартів у судочинстві. Мета кваліфікаційної роботи полягає у комплексному дослідженні основних засад захисту прав людини, їх нормативно-правове закріплення, а також формування уявлення про втілення досліджуваних принципів у національній правовій доктрині та визначення їх ролі, впливу на зміни, що відбуваються в процесі реформування судової системи України.

The object of the study is the public relations that are formed in the process of reforming the judicial system of Ukraine on protection of human rights and freedoms. The subject of the research is the judicial system, the main function of which is the protection of human rights and freedoms, as well as the practical implementation of this function and its legal support, role in reforming the judicial system of Ukraine. Following the Revolution of Dignity, the overthrow of the previous political regime in 2014, the state of Ukraine has taken a steady course of development of the major socio-economic spheres of life of Ukrainian society towards the European Union. Many changes have taken place in the country over the last five years, including in the judiciary. At the same time, since, according to the provisions of national law, the court of justice is the protection of the rights and freedoms of Ukrainians, the consideration of introducing the principles of protection into the judicial system is extremely important and relevant. The whole European legal dimension is built around the protection of human rights and freedoms, and therefore Ukraine, in its quest to become a member of the Union, must adhere to certain European standards in the judiciary. The purpose of the qualification work is a comprehensive study of the basic principles of human rights protection, their legal framework, as well as forming an idea of ​​the implementation of the principles under study in the national legal doctrine and defining their role, impact on changes occurring in the process of reforming the judicial system of Ukraine.
