Децентралізація влади в Україні: конституційно-правові аспекти реалізації

Abstract

UA : Кваліфікаційна робота складається зі 85 сторінок, містить 92 джерела використаної інформації. Взявши курс на вступ до Європейського Союзу, наша держава визначила для себе важливі пріоритетні завдання щодо вдосконалення національної правової системи, приведення правової бази України до вироблених європейською спільнотою стандартів. В основі цих процесів має бути, перш за все, реформа вітчизняного Основного Закону, який, випливаючи зі своєї правової природи, виступає юридичною й політичною базою всієї системи чинного законодавства, має формулювати основні засади розвитку суспільства і держави, бути виявом реальної національної згоди, консенсусу соціально-політичних сил та інститутів. Сучасний етап вітчизняного державотворення характеризується подальшою демократизацією і удосконаленням національної правової системи, приведення правової бази України до вироблених європейською спільнотою стандартів. В основі таких процесів має бути, перш за все, реформа вітчизняного Основного Закону, який виходячи з своєї правової природи має формулювати основні засади розвитку суспільства і держави. Мета кваліфікаційної роботи полягає в тому, щоб на основі аналізу відповідних теоретичних розробок вітчизняних та зарубіжних науковців, законодавства України і розвинутих демократичних держав, дослідити конституційно-правову природу децентралізації влади, та на цій основі розробити пропозиції й рекомендації щодо шляхів здійснення конституційної реформи в Україні у сфері децентралізації державної влади. Об’єктом дослідження є суспільні відносини, пов’язані з проведенням конституційної реформи в Україні у сфері децентралізації влади. Предмет дослідження є законодавство в сфері децентралізації влади в Україні. Методологічну основу роботи складають сукупність філософсько-світоглядних, загальнонаукових принципів і підходів та спеціально-наукових методів пізнання конституційно-правових явищ, використання яких дало змогу отримати науково-обґрунтовані результати. Для проведення дослідження будуть застосовані такі загальнонаукові методи як: аналіз і синтез. Теоретико-методологічною основою дослідження в роботі є історичний метод та метод матеріалістичної діалектики, застосування яких сприяло розглянути всі процеси в розвитку парламентського контролю не виокремлено, а в тісному зв’язку і взаємозалежності з історичним розвитком України, її державності, всіх соціальних явищ, що справили вплив на формування місцевого самоврядування в Україні .

Taking the course of accession to the European Union, our country has identified for itself important priorities for improving the national legal system, bringing Ukraine's legal framework to the standards set by the European community. The basis of these processes should be, first of all, the reform of the domestic Basic Law, which, arising from its legal nature, acts as the legal and political basis of the entire system of current legislation, should formulate the basic principles of development of society and the state, be a manifestation of real national agreement, consensus socio-political forces and institutions. The current stage of national state formation is characterized by further democratization and improvement of the national legal system, bringing the legal framework of Ukraine to the standards set by the European community. The basis of such processes should be, first of all, the reform of the domestic Basic Law, which, based on its legal nature, should formulate the basic principles of development of society and the state. The aim of the thesis is to investigate the constitutional and legal nature of the decentralization of power on the basis of the analysis of the relevant theoretical developments of domestic and foreign scientists, the legislation of Ukraine and developed democratic states, and on that basis to develop proposals and recommendations on ways of implementing constitutional reform in Ukraine. the sphere of decentralization of state power. The object of study of this qualification work is public relations related to constitutional reform in Ukraine in the area of decentralization of power. The subject of the study is the legislation in the field of decentralization of power in Ukraine. The methodological basis of the work consists of a set of philosophical and ideological, general scientific principles and approaches and special-scientific methods of knowledge of constitutional and legal phenomena, the use of which has enabled to obtain scientifically substantiated results. For research, the following general scientific methods such as: analysis and synthesis will be applied. The theoretical and methodological basis of the study in the work is the historical method and the method of materialistic dialectics, the use of which contributed to consider all processes in the development of parliamentary control not in isolation, but in close connection and interdependence with the historical development of Ukraine, its statehood, all social phenomena that made influence on the formation of local self-government in Ukraine.
