Конституційно-правовий механізм формування суддівського корпусу в Україні

Abstract

UA : Кваліфікаційна робота складається з 93 сторінок, містить 70 джерел використаної інформації. Основний Закон нашої держави проголошує Україну суверенною, демократичною, соціальною, правовою державою, а людина в ній визнається найвищою соціальною цінністю. Зміст і спрямованість діяльності держави визначається правами і свободами людини, основним правовим механізмом захисту яких є звернення до органів судової влади, на які покладається обов’язок здійснювати правосуддя на засадах верховенства права, діючи при цьому незалежно і безсторонньо. В даний час, коли завдання створення правової держави в Україні багатьма усвідомлюється як одне з пріоритетних, та як таке, що тісно пов'язане із забезпеченням благополучного майбутнього для суспільства і країни, особливо актуальною є проблема якісного комплектування та подальшого функціонування суддівського корпусу. Метoю квaліфікaційнoї рoбoти є прoведення системнoгo aнaлізу зaкoнoдaвствa Укрaїни яким регламентується формування суддівскього корпусу в Україні, дослідження процесу призначення суддів, розробка рекомендацій та пропозицій до чинного законодавства з питань вдосконалення регулювання даного питання, у визначенні конкретних шляхів удосконалення інституту добору майбутніх суддів. Об’єктом кваліфікаційної роботи є конституційно-правовий механізм формування суддівського корпусу в Україні. Предметом дослідження є інститут добору кандидатів на посаду судді. Метoдoлoгічну oснoву рoбoти склaдaють сукупність зaгaльнoнaукoвих, філoсoфських принципів і підхoдів тa спеціaльних-нaукoвих метoдів, викoристaння яких дaлo змoгу oтримaти нaукoвo-oбґрунтoвaні результaти. Для прoведення дoслідження будуть зaстoсoвaні тaкі зaгaльнoнaукoві тa спеціaльнo-нaукoві метoди як: фoрмaльнo-лoгічний, системний, порівняльний, аналіз і синтез. Теоретико-методологічною основою дослідження в роботі є порівняльний та фoрмaльнo-лoгічний метод, застосування яких сприяло аналізу законодавста України щодо формування суддівського корпусу; дослідженню процесу добору на посади суддів.

EN : Qualifying work consists of 93 pages, contains 70 sources of information used. The basic law of our state proclaims Ukraine a sovereign, democratic, social, rule of law, and the person in it is recognized as of the highest social value. The content and orientation of the activity of the state is determined by human rights and freedoms, the main legal mechanism of protection of which is to appeal to the bodies of the judiciary, which have a duty to administer justice on the basis of the rule of law, while acting independently and impartially. Nowadays, when the task of creating the rule of law in Ukraine is perceived by many as one of the priorities and closely linked to securing a prosperous future for society and the country, the problem of qualitative completion and further functioning of the judicial corps is especially urgent. The purpose of the qualification work is a conceptual analysis of the procedure of forming the judicial corps in Ukraine, the development of recommendations and proposals to the current legislation on improving the regulation of this issue, in identifying specific ways to improve the institution of selection of future judges. The object of qualification work is social relations in the sphere of formation of the judicial corps. The subject of the study is the Institute for the Selection of Judicial Candidates. The methodological basis of the work is a set of philosophical, philosophical, general scientific principles and approaches and specially-scientific methods of knowledge of legal phenomena, the use of which has allowed to obtain scientifically sound results. For the study will be applied such general scientific methods as: analysis and synthesis. The theoretical and methodological basis of the study in the work is the historical method and the method of materialistic dialectics, the use of which contributed to consider all the processes in the development of the selection process of judges not in isolation, but in close connection and interdependence with the historical development of Ukraine, its statehood, all social phenomena that influenced the formation of the Judicial Selection Institute.
