Гарантії здійснення прав вагітних жінок та жінок з дітьми віком до 3-х років в Україні в умовах побудови соціальної держави

Abstract

UA : Кваліфікаційна робота складається зі 129 сторінок, містить 92 джерела використаної інформації. Актуальність теми зумовлена обмеженістю гарантій прав вагітних жінок та жінок з дітьми віком до 3-х років. Об’єктивно, існують перепони та складнощі у здійсненні ними своїх прав, непоодинокими є факти порушень їх прав і це попри те, що останнє десятиліття активно проводиться робота з мінімізації та усунення гендерної нерівності між чоловіками та жінками. В нашій країні, традиційно з радянських часів основна увага вагітним та жінкам з дітьми, особливо віком до трьох років, приділялася в сфері трудових правовідносин. В трудовому законодавстві було закріплено права таких жінок, їх гарантії, та навіть кримінальна відповідальність за їх порушення. Основними видами порушення прав таких жінок є: відмова у прийнятті на роботу, звільнення проти їх волі, залучення до важких, небезпечних, надурочних робіт, робіт у вихідні та святкові дні. Додаткові гарантії прав жінок пов’язані з додатковими відпустками та перервами для годування дитини, щодо яких, нажаль, не визначені критерії та способи здійснення, а відповідно, і гарантії. Залишаються проблемними питання: соціальної сфери, економічних гарантій здійснення прав на материнство та батьківство, в т.ч. державної допомоги сім’ям та одиноким особам з дітьми, охорони здоров’я, здійснення репродуктивних прав та ін. Аналіз міжнародних актів, зокрема: Пекінської декларації, прийнятої на четвертій Всесвітній конференції зі становища жінок 15.09.1995 р., Статуту Організації Об'єднаних Націй, яким проголошено рівноправність та природну людську гідність жінок і чоловіків, Конвенції про ліквідацію усіх форм дискримінації щодо жінок, Декларації про викоренення насильства щодо жінок і Декларації про право на розвиток; правовідносин, нормативно-правових актів, в яких закріплено права вагітних жінок та жінок з дітьми віком до 3-х років, дають підстави для розуміння низки проблем, і не лише в: 1) в трудовій; 2) соціальній сферах. Серед них: 1) гендерна дискримінація; 2) створення умов здійснення репродуктивних прав та материнства; 3) охорони дитинства, оскільки йдеться не лише про права матері, але й права та інтереси дитини; 4) досягнення гендерної рівності та розширення прав і можливостей для жінок та дівчат; 5) 12 пріоритетних для реагування питань, визначених політичною декларацією, схваленою Генеральною Асамблеєю ООН. З більшості з цих питань відсутні нормативні гарантії прав таких жінок, або ж вони є недостатньо ефективними, чи мають загальний характер і не враховують їх особливого статусу та положення. Об’єктом дослідження кваліфікаційної роботи є суспільні відносини в сфері забезпечення прав вагітних жінок та жінок з дітьми віком до 3-х років. Предметом дослідження є гарантії здійснення прав вагітних жінок та жінок з дітьми віком до 3-х років в умовах побудови соціальної держави. Метою кваліфікаційної роботи є: встановлення проблемних питань забезпечення прав вагітних жінок та жінок з дітьми, як в соціально-трудовій, так і інших сферах людського буття, проблеми їх правового захисту, внесення пропозицій з удосконалення чинного законодавства в досліджуваній сфері. Методологічну основу роботи складають сукупність філософсько-світоглядних, загальнонаукових концептуальних підходів до пізнання сутності явищ правової реальності: історичний та діалектичний методи наукового пізнання, та ряд спеціальних наукових методів, порівняльно-правовий, прогностичний, аналізу.

The urgency of the topic is due to the limited guarantees of the rights of pregnant women and women with children under 3 years. Objectively, there are obstacles and difficulties in exercising their rights, there are many violations of their rights, despite the fact that the last decade has been actively working to minimize and eliminate gender inequality between men and women. In our country, traditionally since Soviet times, the main attention to pregnant women and women with children, especially under the age of three, was paid in the field of labor relations. Labor law enshrined the rights of such women, their guarantees, and even criminal liability for their violations. The main types of violations of the rights of such women are: refusal to hire, dismissal against their will, involvement in hard, dangerous, overtime work, work on weekends and holidays. Additional guarantees for women's rights are related to additional leave and breaks for breastfeeding, for which, unfortunately, the criteria and methods of implementation, and, accordingly, guarantees are not defined. Nevertheless, issues remain problematic: the social sphere, in particular, economic guarantees for the exercise of maternity and paternity rights, including state assistance to families and single persons with children, health care, exercise of reproductive rights, etc. Analysis of international instruments, in particular: the Beijing Declaration adopted at the Fourth World Conference on Women on 15.09.1995, the Charter of the United Nations, which proclaimed the equality and natural human dignity of women and men, the Convention on the Elimination of All Forms of Discrimination against Women, The Declaration on the Elimination of Violence against Women and the Declaration on the Right to Development; legal relations, normative legal acts, which enshrine the rights of pregnant women and women with children under 3 years of age, provide grounds for understanding a number of problems, and not only in: 1) in labor; 2) social spheres. Among them: 1) gender discrimination; 2) creating conditions for the exercise of reproductive rights and motherhood; 3) protection of childhood, as it concerns not only the rights of the mother, but also the rights and interests of the child; 4) achieving gender equality and empowering women and girls; 5) 12 priority issues to be identified, identified by a political declaration approved by the UN General Assembly. On most of these issues, there are no regulatory guarantees for the rights of such women, or they are insufficiently effective, general in nature, and do not take into account their special status and status. The object of the qualification work is public relations in the field of ensuring the rights of pregnant women and women with children under 3 years of age. The subject of the study is the guarantee of the rights of pregnant women and women with children under 3 years of age in terms of building a welfare state. The purpose of the qualification work is: to identify problematic issues of ensuring the rights of pregnant women and women with children, both in social and labor and other spheres of human life, the problems of their legal protection, making proposals to improve existing legislation in the study area. The methodological basis of the work is a set of philosophical and philosophical, general scientific conceptual approaches to knowledge of the essence of the phenomena of legal reality: historical and dialectical methods of scientific knowledge, and a number of special scientific methods - comparative law, prognostic, analysis.
